Questions relating to my AOS submission from TN Status

Hi Folks,

I have been lurking and reading this forum recently to gather as much help as possible without duplicating my questions. I decided to join this evening as I have several detailed questions I'd love help with.

First some background: I am Canadian, and recently married to a US Citizen. I have been in the US working on a TN Status and wish to apply for my green card. We've got our application complete and I am in the final stages of preparing the package to submit. I'd like to ask some questions as I know many of you on this forum have experience with AOS applications. I have several questions so I'll number them.

1. On I-130 where it says ‘date arrived’ next to the i-94 number – do they want the most recent date I arrived in the USA or do they want the date the i-94 was issued?

2. Throughout the forms they ask for my status. Should I put TN-1 status or TN Status – in certain spots it doesn’t allow for me to put the ‘-1’ but that seems more correct.

3. Should we submit one detailed multi-page cover letter or one for each section? I’ve planned to use an overall cover letter followed by individual ones for each section. Thoughts?

4. Who should sign the checks – myself or my USC husband

5. I-864ez has anyone used it to adjust status from TN Status? We fit the criteria outlined on the instructions.

6. For the I-864/I-864ez is it recommended to include an employment letter? We have 3 years of tax data, plenty of pay stubs. We’d prefer not to get an employment letter as that can take time and we wish to submit our package ASAP.

7. For evidence of a bona fide marriage should we have an affidavit signed by someone we know – we have extensive evidence without it (joint accounts, joint title of a vehicle, joint ownership of our home and mortgage, a newborn, wedding photos)?

1. Most recent.

2. I think either is okay. if you want to be exact, hand write in TN-1 if it won't let you type it.

3. Just one cover letter for the whole thing.

4. Whoever is on the checks/bank account.

5. The "from" status makes little difference. If your husband qualifies for I-864EZ than it is fine. Do you mean I-864W maybe?

6. If you have paystubs then employment letter is not needed. Either suffices for proof of current employment.

7. With your evidence, I don't think you need affidavits too.

The reason I was asking about the check is I was planning on signing it but the account is still in my maiden name - will that cause confusion?

And I didn't know a I-864w existed until you posted it... But, Nope don't qualify for that, the I-864ez we qualify for as we only need to use my hisband's income to verify support.

Once I get through the endless copying of documents we can submit!
