My wife wants to sponsor her brothers to come the USA after she becomes a US Citizen. 1 Brother is Married with Children and the other Brother is Unmarried. Both brothers live in India.

If my wife directly sponsors either brother, how long will it take for them to get a visa? What class of visa will they receive? Someone told me it would take 10-12 years for her brothers to receive a visa.

To save time, can my wife sponsor her mother to come to the USA? What type of visa will her mother receive and how long will it take for her to get the visa?

After her mother gets a visa and comes to the US, how exactly would the mother sponsor her Married Son (i.e. Married Brother of my Wife) to come to the USA? Will her Married Son be able to come over to the USA along with his wife and children (at the same time)? What exactly would be the process to sponsor her Married Son - and in turn his family - and how long will it take for them all to come?

About two years for the mother. If the child sponsors a sibling it's about 12 years.

The mother could alternatively sponsor the additional siblings herself once she arrives here, and that will again be about two years.

How old is the unmarried son/your brother?

It will take more or less a year before mother can immigrate via IR5 category. Your wife must be a US citizen to petition for her mom.

Once mom immigrates, she can file i130 for her unmarried son. Waiting time will vary depending on unmarried son's age upon filing (either F2A or F2B category). He must remain single/unmarried during the entire process. Marriage will void his petition.

Mom cannot petition for her married son. LPRs cannot petition for their married children. She must Naturalize first before she can file i130 for her married son (F3 category). The wife and children below 21 years old can also benefit from that petition as his derivatives.

For siblings from India the current Bulletin shows 15Dec01 so over 13 years and likely to grow before it becomes current.

For mom filing for unmarried son over 21 it is 01APR07 and for children it is 01MAY12

Thanks for the informaion guys. The unmarried son is about 22-23 and the married son is about 37.

Unmarried son will be under the F2B category. He will wait at least 7 years (for India).
