I saw on VJ that evidence of a bona fide marriage is required as part of the I-130 submission but in what seems like a contradiction, VJ also says this evidence is required for removal of conditional status when renewing green card @ 2 years minus 90 days for the interview. My I-130, G-28 (for lawyer representation), and G-325as are being sent out on Friday and my lawyer is telling me the evidence is not needed now - it's needed later for interviews. I'm confused....when is the evidence really needed?

Yes it is really needed, like the instructions say.

More new evidence is also needed for I-751.

You will have to show proof of a bona fide marriage many times.

What country is the beneficiary from?

More and more the Service Centers are really growing tired of people sending nothing but a marriage certificate and sending out RFE's (Request for Evidence). Many lawyers are misguided and ignorant to what the CO at embassy wants.

Think this way your petition will go through many hands and many notes will be taken if you have a real relationship and not one just for immigration purposes. How will they deduce and make that decision if they are given nothing?

And depending on your embassy and the country it is vital like Harpa says it can mean an approval or denial.

When you removed conditions you show more evidence but this time its evidence of living together as husband and wife and co-mingling finances and your lives.

My husband is in The Netherlands. I have no problem putting together the evidence. It's almost all in a pile just waiting for me to organize it. I offered it to the lawyer as part of the package I sent him but he said keep it for now.
