I've been told on here and heard elsewhere that working without authorization, overstaying a visa and maybe a few other things are pretty much forgiven if you're married to a USC.

I hope this is the case anyway, as my husband did both (long story but in my heart I feel he did what was best for his family, etc).

Doing some reading, I found some legal texts where it said that AOS will be denied for admitting to have worked without authorization.

Has anyone heard of any real cases where and AOS filed after marriage has been denied in those grounds?

It's usually forgiven if the applicant is married to a US citizen. Otherwise it is grounds for denial.

Canadian on TN Status married to USC

07/18/06 - Forms (I-485, I-130, I-765) sent overnight to Chicago Lockbox

07/19/06 - Received Date

07/25/06 - Notice Date

07/26/06 - Cheques Cashed

07/31/06 - I-130, I-765 Added online (I-485 not online yet)

08/04/06 - Receive Appt. letter for FP/Bio

08/14/06 - FP/Bio taken / LUD on I-130, and I-765 / I-485 added online

08/18/06 - RFE sent for Tax Return stuff, which was already sent with application

08/25/06 - RFE received by me in mail

09/05/06 - RFE returned to USCIS

09/11/06 - RFE Received by USCIS

10/31/06 - InfoPass to check status on 485 and 765 - Apparently a push has been made on 765

11/06/06 - I-765 (EAD) Approved!

11/13/06 - Received EAD, Approval notice mailed for I-765?

11/20/06 - Receive Interview Letter

11/29/06 - TN Expired

01/04/07 - Interview! - APPROVED!!!!

01/22/07 - InfoPass Appt: Got I-551 stamp in passport

01/24/07 - I-485/I-130 Approval E-mails / Welcome notice sent

01/25/07 - Card ordered

01/29/07 - Received Welcome Notice/I-130 Approval

02/02/07 - Received 10 yr Green Card!!

Because they'll find out anyway? I know my husband paid taxes even though he was unauthorized to work, so it wouldn't be hard to figure out.

My husband doesn't work under the table, he pays taxes. He's just not legally authorized to be employed. Anyway, that's not the point...either way, I'd rather tell them up front than have them find out (which in our case, it would become obvious) we lied and get denied for that.

i guess that would be called an *audit* but really has nothing to do with this threaD.

Hope that your husband isn't caught or you will suffer while he's deported, this is, if he's not a citizen yet. GC doesn't deny the US govt from kicking you out of the country for certain crimes. Remember, only US citizen can get away with certain things, such as being a taliban member and living in afghanistan....

On the larger question of denial of AOS even married to USC. Here are some observations and facts.

No... unless the alien is involved has issues of moral turpitude (smoked weed and got caught, charged with dui, felony), conditions will bar him or her from completing a successful AOS. If you are married to a US citizen, working without permission, overstay etc, are forgiven. However, if you never paid taxes when you were working illegally, it could be grounds for denial, till you pay them.

However, marriage to a US citizen pretty much cure minor indiscretions, but not the major moral misbehaviors...such as being caught with a dead hooker in your manhattan apt... :wacko: If you are an immigrant, wait till you are a citizen to commit your worst crimes... if you so desire...

Missed the ex part... understood.... I hope the one you are married to is paying all his taxes, including doggy taxes in your state. Irrespective of whether you have a dog or not...
