I hold both B1/B2 visa and K1 visa. I came to the USA on B1 first time and then entered into USA on K1, married my fiancé and now I posses a green card, but due to unavoidable family issues, I have to return to my home country and can't reside in USA ever.


But I would want to come to the US at least once a year to visit my friends and on business trips. My question is if I divorce my wife, will I be able to use my B1/B2 to visit for a couple of weeks a year, because the B1/B2 is valid for 10 years.


Please respond as soon as possible. Its very urgent for us to know all the possible options.

Well, if you chose to leave the US you will abandon your residence status and GC. You can still travel to the US using your B1 as long as it is still valid and has not expired. Having issued a K1 and gone through the process does not revoke the B visa. As long as it remains valid you can use it to travel to the US.

My husbands income does not quite reach the 125% thresh hold to qualify for Affidavit of Support so, i have asked my uncle to be a co-sponsor because he has a good income. However he also has a wife and 3 kids. My question is does the immigration people add my uncles income to my husbands in order to calculate the final figures. TIA

That is correct. If you want to abandon your residence, leave and return your GC to the consulate in India. As a former resident you should not have any major problems in getting a visitor's visa renewed in the future, provided you meet the basic criteria.
