Hello all!

Background info: Met on World of Warcraft, Scotland/US relationship and got married in Glasgow on Jan. 4th of 2013. Husband is from Scotland and we've been trying to get him a green card so we can finally be together in the US.

So my husband and I have been working on his green card for almost a year and a half now and we think we're on the last leg of the journey now. We're currently trying to get his CR-1 Visa for conditional residency so he can come over and we'll adjust his status from there.

I've filled out an i-129f and and i-130 both were approved and sent to the nvc, and I was told my husband needed to fill out a ds160 form. Now from what I understand a ds160 is not for permanent residency, it's just temporary. So does he need to fill out a DS260?

He's on his way to London now for his medical exam which is needed for his paperwork.

From anyone who has done this, how long after his medical can he book for his interview, what do we need to have filled out, and what fees are associated with this? It's getting very blurry now that we're near the end of the process and we just want to make quadruple sure that we have everything right.

ANY info is helpful at this point and we would love to hear from you all, thanks so much!

CR-1 visa holders do not adjust status. Upon arrival, a standard CBP entry stamp will be placed on the page next to the visa; this combination acts as a temporary green card until the actual one arrives in the mail. You may be thinking about Removing Conditions on Residency which is a process that will not occur until the issued green card is close to expiring.

I think you need to call the NVC and find out if it was maybe the i129 that made it through... that one is a non-immigrant visa, and might require a ds160 instead of a ds260.

If you talk to someone there, find out if they're going ahead with the K3 instead of the CR1. Technically, the K3 might still reunite you faster, but it's more expensive and he won't be able to work until you adjust status. If both were approved, you might want to wait until the I130 makes it through to NVC and carry on with that one.

Either way, your first step is to call the NVC (you'll have to dial a million times until you don't get a busy signal and then wait on hold for 20-40 minutes to speak to an operator), at which point you'll give them your USCIS receipt numbers or NVC case number and explain your problem.

That would be my advice as well, except you don't simply "wait until the I-130 makes it through". You must interact with NVC numerous time. First clarify which petition is the visa interview scheduled for. If it's the I-129F, find out what the status is for the I-130.

You are not "getting him a green card". Right now, you've petitioned, and are in the process of applying for a visa. Which visa is unclear until you call NVC an verify. Eventually, there will be a green card, but only AFTER a visa is issued and used to enter the USA.

OP - if he is 'being told' to fill out a DS-160,

then

that I-129F petition made it through to London IV

and

he is currently chasing after a K-3 visa, which requires another set o stuff filed to get a greencard, after arrival in the USA.

Are you certain you want him to hold a K-3 visa? It's very painful, almost impossible to participate in the USA with it - cannot get a SSN , cannot work, etc.

If I were in yer shoes, I'd contact NVC and inquire about the I-130 and seek to set up a Visa Application with NVC, seeking a CR-1 visa. It's superior and costs less . Sure, its a bit more time, but hey !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Both the i129f and the i130 were filed. Processed and approved. All of which was forwarded to London.

When I enter my case number into the ceac site it says I'm ready for an interview with the embassy in London. I literally just today completed my medical today. Which the embassy will receive by the end of the week.

As a couple have suggested my wife will call the NVC tomorrow to confirm what exactly is going on.

The above makes no sense. Unless you interacted several times and paid two fees to the National Visa Center, the only thing that COULD be in London is the I-129F. NVC doesn't process both petitions when they come in together. They stopped doing that February 1, 2010.
