Ok, WTH, is going on with the USCIS??? I sent in our AOS packet, checked everything a billion times just like with the K!! Today in the mail I received a Rejection Notice for our I-765, It stated.... Your I765, fees, and supporting documentation is being returned to you for the following reason..

The check amount is incorrect, or has not been provided. Please review the form instructions for fee information. Please resubmit the packet with the fees, to the address provided,

I called them, because I read several times that there is no fee when filed with AOS, which is exactly what I did! They told me that I am to attach a sticky note, telling them that I don't need the fee cause it was filed with the AOS!

My question is, there is none of the supporting evidence that a I765. should be sent in with, and it was all sent DO I have to send more info in because of that

Notes: To be considered for deferred action for childhood arrivals, you must file Form I-821D, Consideration of Deferred Action for Childhood Arrivals; Form I-765, Application for Employment Authorization; and Form I-765WS, Form I-765 Worksheet, with the correct fee or your request will be rejected and returned to you. You may not e-file your form I-765 if you are requesting consideration of deferred action for childhood arrivals. The 90-day period for reviewing Form I-765 filed together with Form I-821D begins if and when USCIS decides whether to defer action in your case.

If you are an asylum applicant, you may be a member of a class action lawsuit (known as the ABT class action lawsuit) that addresses how USCIS and the Department of Justice calculate time credited to asylum applicants for eligibility to work in the United States. not true and most of the forms mentioned are for the EAD for deferred action

not for a GC

when the i765 is filed with the i485 concurrently there is no fee. do you have a copy of your i485? send that with it and a note stating you filed the i765 with the i485

Did you also attach a copy of the I-797c NOA (of your I-485) with your I-765?

Did you file it with the I-485 or after? Did you put category (c )(9 )? Just send it back with a copy of your I-485 receipt notice and make sure to put (c )(9 ) as the category.

Yeah I filed it with the I-485, and all the other forms for AOS, I haven't received the reciept letter yet for my I-485, do you think I need to wait for it to send this back to them??? I did get the email message and when I look online it says that I should be getting the biometrics appointment in the mail soon.

I do have copies of the I-485, I will definitely attach it!

Unless I'm reading the instructions incorrectly, I'm with Ronald and Elvira, it does look as if there is a filing fee for the © (9) category. On Page 8 of the instructions it lists the Exemptions, and that category is not one of them. There is no EAD fee if one is applying with AOS.

Check the NOTE under Replacement EAD page 8 and then another note on page 9.

There is NO fee when filed based on a pending I-485.

We deal with this issue every single day in this forum. It is well-known.

You are mistaken; there is no fee under C-9 when a fee has been paid for the I-485.

Read the instructions again.

Since they screwed it up -

I suggest resend the form with a photocopy of the I-485 receipt notice

and

a nice coverletter explaining that the fee is waived when submitted with the I-485, and state (clearly) that the human processing the paperwork made an error .

There is no EAD fee if one is applying with AOS.

Check the NOTE under Replacement EAD page 8 and then another note on page 9.

Yeah, we double and triple checked it. Also it says that all the supporting documents were sent back to us... Only thing that is there with it is a copy of the envolope I sent it in and the form to have notifications. So I copied my husbands passport page for identification and his visa, got two more passport photos, added a copy of the I-485, a copy of the NOA for I-485, a copy of page 9 instructions with the section saying the fee is waived highlighted, and a copy of the canceled check, showing the payment for the I-485 along with a letter explaining that they screwed up!
