TN is a non-immigrant visa while IR-1 is a immigrant visa so I think you can't apply for TN because you have to show no intention of establishing US residency beyond the validity of the TN visa, that is not true if you are in the IR-1 visa process.

Feb. 4/05 - Sent I-129F (Vermont)

Feb. 9/05 - NOA1

April 6/05 - NOA2

May 12/05 - Packet 3 (second one, the first was lost in the mail)

May 19/05 - Police certificate (RCMP London, ON)

May 20/05 - Packet 4 with interview set on July 26/2005

May 25/05 - Medical in Toronto (dr. Seiden)

July 26/05 - Interview in Montreal (successful)

Aug. 15/05 - Visa and the brown envelope in hand

Sept. 28/05 - Moved to the U.S.A. (Ambassador Bridge (Detroit) POE, asked for and got temp. EAD stamp on I-94)

Oct. 6/05 - Civil wedding ceremony

Oct. 8/05 - Religious wedding ceremony

Oct. 13/05 - Sent AOS/EAD/AP

Oct. 14/05 - Applied for SSN

Oct. 22/05 - Received SSN card in the mail

Oct. 24/05 - NOA for AP received (issued Oct. 21)

Oct. 25/05 - NOA's for AOS/EAD received (issued Oct. 21)

Nov. 4/05 - Appointment letter for AOS fingerprints/bio for Nov. 15/2005

Nov. 15/05 - Fingerprints/bio taken for AOS and EAD

Dec. 19/05 - EAD/AP approved

Dec. 27/05 - Received EAD card/AP

Jan. 28/06 - Appointment letter for AOS interview (set on March 15, 2006)

Mar. 15/06 - AOS interview (successful)

Mar. 18/06 - "Welcome to the United States of America" letter

Mar. 25/06 - Received Green Card (good for 2 years)

Dec. 18/07 - Sent I-751 to VSC

Jan. 03/08 - NOA

Feb. 7/08 - Biometrics

You will get more people seeing this post if you post it in the cr-1 / ir-1 section

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

TN-1 attempt while IR-1 app in process? Bad idea--as applicant will be red-flagged.

CR-1 from (existing) TN-1: possible, but not ideal (better to do full-package--EAD/AP--AOS, and ensure not leaving US till AP in hand).

IR-1 from (existing) TD: (see CR-1 from existing TN-1--best to do derivative AOS).

2008/08/22 I-751 biometrics completed

A TN visa is only available to those who have no immigrant intent. Once you file an I-130 that won't be the case. So no... if you have an I-130 filed, you cannot get a initial TN or get it extended.

I used to work for the CBP...

From NAFTA

1. Each Party shall grant temporary entry and provide confirming documentation to a business person seeking to engage in a business activity at a professional level in a profession set out in Appendix 1603.D.1, if the business person otherwise complies with existing immigration measures applicable to temporary entry, on presentation of:

(a) proof of citizenship of a Party; and

(B) documentation demonstrating that the business person will be so engaged and describing the purpose of entry.

This gives the basis for granting TN status.

Note that temporary entry is defined as

temporary entry means entry into the territory of a Party by a business person of another Party without the intent to establish permanent residence.

Are you serious when you said "you used to work for CBP" --I am sorry to doubt you because I got an US offer and they asked me if I can work right now? So I am in a hurry to collect relevant information and answer that offer. Do you suggest me to wait for immigration visa instead of taking risk to apply for TN visa? The thing I am thinking to apply for TN is someone told me POE office doesn't ask the consider if the TN applicant has immigration intention.

CBP = Customs and Border Protection... the people at the border and the people who will issue your TN status...If I wasn't serious, I wouldn't have said it

The law is clear... TN is only for people who will be temporarily residing in the US... you have immigrant intent... Therefore, you are not eligible for the status...

Whether or not CBP find out about your intention is not relevant... By not revealing your intention, you would be making a material misrepresentation. If someone finds out about that misrepresentation, you could be subject to a permanent bar on entry to the US...

So how good does that job look now...Don't look away from the larger goal... being with your loved one by trying to do something that may in your mind be expedient, but could turn out to put you very far from that goal.

I would probably feel them out about the possibility of keeping the job open until the time that you can get your immigrant visa...
