Employer Letter- Necessary?

Hi all,

I made out a letter for my boss to sign about a week ago and left it with her to look over and sign. She told me she would get to it. I reminded her again about it and she said she has just been busy and hasn't had a chance to look at it. It literally only needs her signature. I did the rest.

Will it be OK if I don't have an employer letter? I am sending paystubs and tax transcripts to my fiance for his interview. On the Packet 3 Checklist it says: Letter from employer, but has (Employment-Based Visas) after it. I wanted to send it just to be extra thorough. Will it hurt us if we don't have it? If it will, I will keep bugging her, if not I may just let it go.

That's a hard question to answer. At my interview they asked me for everything I had. She wasn't specific about what I need (other than the affidavit itself) didn't tell give me any feedback about what was or wasn't needed.

If you have a years worth of payroll deposits up to the most recent one, that would probably satisfy them. I imagine the letter is more pertinent to someone who hasn't held their current job very long.

I have been at my job for 2 years. I have 7 months worth of paystubs ready to send to him, but I can gather even more if it will help.

I sort of expected her to drag her feet. I have worked with her long enough to know her ways LOL. The letter is all of 2 sentences so I'm not sure what the deal is. I explained exactly what I needed it for. She is old fashioned so maybe she is uncomfortable with the situation or scared she may somehow be accountable? Who knows. Just sign it lady!!

You should not need both the letter from employer and recent pay stubs. Just your most recent tax transcript, letter from employer and/or pay stubs is what is typically used with the I-134(and the same for the I-864 later during AOS too).

n. Proof of Financial Support (Form I‐134) and photocopy of supporting documents (IRS transcript
or photocopy of the most recent Federal income tax return, bank statements, employment pay

My fiancé requested HR to make the letter and the letter was then forwarded to his boss to sign. It was in their office stationary, indicating his years employed to that company and salary. We also included a months worth of paystubs in our packet.

No need to send the paystubs. Tax transcript is the important one. You can send the affidavit package to your fiance and later you can send him the employment letter after it's been signed.

Employment Letter and paystubs are optional but they are helpful. If you work for a company that utilizes theworknumber.com for employment verification you can print out your own letter of employment, their is a tab their for immigration. If you are not able to get the letter done by your boss, you paystub should suffice as proof of current employment but again these things are optional, just good to have.

Paystubs/Employment letter are what show that you currently have sufficient income

The tax transcript is verifying that you had enough income in the past to reasonably assume that you will continue to have sufficient income.

In my opinion - since the employment letter is not required - If you are not able to get your boss to sign the employment letter, you can send the transcript as well as your pay stubs for this year and that should be enough.

Thank you for that info! I think it was Packet 3 that said Employer Letter (For Employment Based Visas). Since a K-1 isn't an employment based visa, it didn't sound like we would even need one on that either.

I feel better now about not having it. I sent her another reminder email today. We work in different offices about 20 minutes apart or I would just breathe down her neck. If she doesn't do it, I will just send what I have and hope for the best. It takes about 6-7 business days to get mail to my fiance and I would like to have time to go over everything with him before the interview.

I have no idea the packet 3 of K-1 visas from Canada. From my experience received of packet 3, the employer letter was just an optional ( it was on the list for affidavit of support). My then-fiancé ( my now husband) did not include employer letter. What he provided me those were his paycheck, W-2, ITR, bank saving accounts, policies insurance. What the embassy was asked from me those were W-2, ITR, and original I-134 form.

Thank you Kay Turns out I was looking at the wrong thing completely. It would still make me have peace of mind to have the employer letter, but if I don't I guess its not the end of the world.
