Firstly, I'll tell you the situation. Last year I finally emigrated to USA from UK to be with my American wife. I now have Green Cad with conditions attached and will be losing those conditions, hopefully, in 12 months time. My daughter, who is 13 years old and from a previous relationship would now like to come and live in America with her new stepmom and I. I have seen various ways of doing this but cannot find a definitive answer, so here are my questions.

1. Is the I-130 route the only route?

2. Do I have to file I-130 while she is in England or can she come over beforehand and file it while she is in the states, thus, her not having to return to England.

3. If she does come over while filing is in progress, will she be able to go to school, will I be able to register her on our health insurance.

The I-130 filed by her USC step-mom is the only way.

Daughter can come for a visit within VWP terms, but would not be able to live in the US or attend school without proper immigrant visa/permanent status.

For now, I suggest yer USCitizen spouse file an I-130 to the Chicago lockbox, with her being the petitioner.

Eventually, stuff will get routed to NVC and she can follow up with the fee payment and visa application there,

all leading to a

CR-2 visa [maybe an IR-2 visa by the time the lass interviews]
