My drivers license officially expires tomorrow, I've not received any confirmation no NOA1 or hint that my packages has been received. The check hasn't been cashed and as of tomorrow I don't really know what i'm going to do as I need to drive for work. Do I have options here? Can I contact someone? Can I even check that it was received? Worse even what if it wasn't? Vermont has it. I'm worried.

I will have no documents that are within legal date is the point. The only thing making it legal is that fact that no one else knows. Which is fine for work my boss won't care as long as it's in the works. I'm not a driver by trade i'm a network engineer that NEEDS to drive, i'm on call. So if something breaks driving down to a remote at 2am just isn't gunna fly considering... well I have no legal IDs anymore. You see my point, I can't even prove I've filed for it beyond a receipt from fedex but try showing that to a Georiga cop at 3am in hicks villie USA. Neeeeeeeewp, I already get funny looks cuz of the accent. I'd just like to avoid as little friction as possible but it doesn't seem to be my style.

The only thing besides waiting for the extension letter is to try to get a I-551 stamp in your passport at a local USCIS office. You sent it towards the end of the window and NOA1s seem to be taking a little while, so hopefully they accept those facts and give you the stamp. The stamp is proof of LPR status.

Driving beyond tomorrow will be a good way to get a "driving on an expired licence" charge, which probably won't work out great for you in the long run.

I don't think your local office will give you an I-551 stamp until you have the NOA for your I-751 to show them.

So... I can't check if they received it. I have no way of knowing whether I'll even get an NOA1, it's unlikely I'll get this stamp thing as I technically have no proof. I have to tell my boss that my co workers will have to drive me everywhere, I can't get to any meetings and I can't be on call. My status is up in the air as I'm sure if they didn't receive it, I'll technically be illegal as of tomorrow, not to mention the little things like potentially losing my life here and marriage or at the very least my job, or my time energy and money trying to fix a mistake that's not mine . OR if that sounds to pessimistic for you, they DID receive it and just blindly wait for x amount of time while all of the above might also be true anyway. Or have I missed something?

If they have not cashed your cheque in 90 days then I would be pretty certain they do not have it.

Check your bank statements.

If you fail to properly file Form I-751 within the 90-day period before your second anniversary as a conditional resident:

  • Your conditional resident status will automatically be terminated and we will begin removal proceedings against you
  • You will receive a notice from us telling you that you have failed to remove the conditions
  • You will receive a Notice to Appear at a hearing. At the hearing you may review and rebut the evidence against you. You are responsible for proving that you complied with the requirements (we are not responsible for proving that you did not comply with the requirements)

Mine kind of expires tomorrow, is there anything I can do that I wasn't already doing 3 times day for the last 3 weeks?

You sent your ROC during the correct window, so you do not need to worry about losing your LPR status. Your NOA1, once you get it, will be back dated to the day they physically received your package at their facility.

Because you sent it in towards the end of that window, it seems you might have an issue with your License. It can take USCIS up to 30 days to cash the check and issue the NOA1 extension letter. It has been 2.5 weeks for you so far. So worst case scenario, you won't be able to drive for a week or so.

You could still try for the I-551 stamp now.

I like you Harpa you're a glass is half full kinda person. But I'm a tell it like it is kinda guy and that is NOT "the worst case scenario" but it gives me hope and I guess in a situation where no one has the spine to say " I don't know " or " you might be screwed, make sure you have you're paper work in order " hope can get me through for another 2.5 weeks. I wouldn't be so stressed I guess if I didn't have an 8 HOUR lab exam tomorrow that i'm currently not studying for because my brain has entered sieve mode. But the lack of direct response has answered just as clearly as one itself might've. If I don't get an NOA1 I'll get a court date letter.

Everything with your ROC is fine. Don't worry about that. It took them 5 weeks to send NOA1 for us and about 3.5 to cash the check. I remember thinking that was mad, but it worked out in the end. It was happening to other people at that time too. I have read that it is happening again lately. You won't get kicked out or anything. Everything is super fine on that end.

It seems like you might have an issue with the license lapsing for a week or two, and that sucks.

Come to think of it, I remember that some people never got NOA1 and were able to go get a I-551 stamp with no issue. Since your GC has expired, I think you would be able to get the stamp. Your issue is not enough time, instead of never having received it, but they should be able to accommodate you.

I thought our NOA1 was lost for a while, so I called them after 30 days and was able to receive our case number over the phone. They looked us up by name.

Go study and don't worry about ROC. Figure out the license thing after the exam (or set an INFOPASS appointment now for later this week and then let it go). Good luck.

When you sent the package, did you get a tracking number or delivery confirmation? If so, the first place to begin is with USPS (or whatever alternative service you might have used) to determine if the package was actually delivered. If there is a tracking number, go to the USPS web site and plug in the number to determine if the package was actually delivered - and where it was delivered.

USPS sometimes gets quite creative when delivering packages; they mis-delivered three parcels addressed to me in the past six months. None of these packages were immigration related (thank God), but it still indicates that the potential for mis-delivery is present.

I don't know how well it would fly with a police officer or whether it would be legal to drive on as you're not a tourist, but I have heard of people keeping their UK licence. Unless you have a medical condition that would be unexpired.
