Context

We submmited for the AOS the W-2s but we forgot to include the tax transcript so this may be main issue for this RFE.

He (sponsor) has been employed for the last 7 months approximately, the last tax transcript report (2013) doesn't shows enough to cover the 125% poverty line income requirement, even thought, if he worked the whole last year we could easily cover the 125%. Even we input enough earnings based on how much he will earn if he worked for the whole year,we also included enough assets proof.

The RFE is requesting

  • The petitioner/sponsor of Form I-864, Affidavit of Support, must submit a complete Federal income tax return submitted to the Internal Revenue Service (IRS) for the most recent tax year.
  • Submit all supporting tax documentation (W-2s, 1099s. Form 2555, and all supporting tax schedules) submitted to the Internal Revenue Service for the most recent tax year.
  • Based on the documents submitted with form I-864, Affidavit of Support, for the petitioner/sponsor, the income did not meet the 125% of the poverty guideline for the petitioner/sponsor's household size.

Questions

  1. Based on the context can we provide enough proof that he has enough income or we just better start looking for a join sponsor?
  2. All this requests are linked together and that might be the reason they say that we didn't cover the 125%?
  3. What happens if we submit the complete information and they say we still don't cover the 125% can we submit once again with a joint sponsor?

Word of advice: joint sponsor, don't take a chance.

It's very difficult for us to get a joint sponsor, we already asked 3 friends of him and they said no, we are really low in options about join sponsor and we would like to let that as our last resource.

It is not easy to find co-sponsors because this will require non-disclosure of the gross income people have and their SSN too. So, most of the time, people ask help from the family of the petitioner. Have you tried talking with his parents or siblings?
