Hello,

My brother 17, has recently shown an interest of moving to the US in the future. For example if I am a LPR can I apply for my parentsm (with my brother being a derivative) or do I have to wait until I become a USC?

If the latter, I understand my parents would be classed as Immediate Relatives, which I understand cannot bring derivatives - so how would they bring my brother?

What is the best way for my brother to get over?

I plan on opening a bar/grill when I get over to the states in a few years, if that in any way helps.

Hi

no, only USC can petition for parents and siblings

there are no derivatives in parents petitions, so he will be left behind. petitions for parents are filed separately, and the wait is a year or a little over a year

Depending on your path the USC ( 3 years as a spouse of a USC or 5 years) your brother will be an adult before he gets a petition in the front of the que and will have a very long wait. Under the current process you get USC then aplly , it takes about a year for your parents over 12 for you to apply for a sibling ( advance is they can get married ) Your parents take about a year to process then they can apply for your brother. At best your brother will be 20 and will probably become 21 which puts him in the class for UNMARRIED adult children of LPR and that also is about a decade of waiting.

This will not be over quickly. You will not enjoy this.

OK well thanks all, it looks like he wont be getting to the states through me anytime soon. Will tell him to either go to college and study hard or find himself an american sugar moma haha oh and of course the diversity lottery!
