Do your paystubs show a year-to-date amount on them? If so, then going back 6 months is not likely as important as having perhaps a recent few.

You aren't filing today, so going back six months isn't necessary. He doesn't have his visa yet, he hasn't moved, you have yet to marry, and get your AOS together. It could be 3 months or more before you file, so start collecting now and see how many you have by the time you mail AOS.

The only thing REQUIRED to accompany the I-864 is the most recent tax return. But most people want to add additional evidence to make it very clear what their current income is, especially if they make more than their 2013 tax return indicates....because they got a better job, or a raise, or graduated from college and started their first job.

pay stubs and a letter from the employer is not required, but both are good to provide. I suggest 6 months because of what the instructions say.

My husband's pay stubs say his yearly salary on them but we still provided 6 months (which was the time period he had the job actually.)

You don't have to provide either and just an employer letter can and does work.

I only have in my possession stubs from as far back as mid-March. His interview is the 23rd of May so if he gets approved he will be flying in first week of june. We have 90 days to marry naturally so he would of had to AOS by around September 7th. That's cutting it close if we want 6 months worth of pay stubs. And it clearly indicates you need 6 months worth. Can't I just do 5 months? Or do I have to do 6 months?

Five is better than zero, right? You have a tax return. You have an employer letter. This is third proof, so do the best you can. It is not required.

LET IT GO and don't think you have to do everything exactly as somebody else. I don't have pay stubs. Didn't send any. I don't even have a job. Haven't worked full time in decades. Still had my I-864 approved with no RFE or interview. Show them you qualify with the best you can put together and that will be enough. Anything you send besides the required tax return is icing on the cake to sweeten the deal.

You mean as in the only evidence with nothing else? No. Of course not. You need to send a copy of your 2013 tax return. It's a requirement. In addition to the return, you can send a letter from your employer on company letterhead, 6 months worth of recent pay stubs. Did you read the i-864 instructions ?

Of course I will be sending in my 2013 tax return and in a addition I will be sending in letter of employer. Hopefully those two things are enough.

It's just when they say in the language 6 months it seems they are saying that if I choose to send pay stubs it HAS to be 6 months worth.

Don't worry. Send whatever you have 5 months or 6 months worth of pay stubs. They are good proof of CURRENT INCOME and the letter from your employer as well is good proof of current income

The letter from employer I have now is dated from March 13th. Should I provide this one or ask for a more recent copy? Since the language indicates recent. I just don't want to bother my boss for ANOTHER letter if I don't have to.

Don't worry to much. Employer letter from March 2014 is enough if you also submit your most recent pay stubs. (letter from employer dated march 2014 plus lets say if you file in Aug 2014 then submit pay stubs from March to August)You won't get RFE if you submit 4 or 5 months paystubs specially if you have submitted most recent pay stubs.

February 28- AOS package sent. ( I-130, I-485, I-765)
March 5- Package delivered to USCIS Chicago.
March 11- Email and text notification with Receipt Numbers.
March 14- Hardcopy of NOA1 for all three applications.
March 21- Received biometrics appointment letter for 04/04/2014
April 2 - Completed Walk in Biometrics appointment successfully. (Original Appointment was for 4th April)
April 9- I-485 Case status has been updated to " Testing & Interview "
April 16- Text and email alert for case update for AOS interview on 22nd May 2014.
April 18- Hardcopy of Interview notice received in mail.
May 22- AOS interview, approved on the spot and got stamp in my passport.
May 27 - Approval notice of I-130 and I-485 in mail.
May 29- Received GC in mail.

It's ok corvusheart.i am from indonesia-3rd world country and my fiance only provide his paystubs on January (i have interview on march).that's the month that he just above poverty line.your fiance is from UK.so i think the officer won't give you such a hard time :)

5 is better than zero. I was simply explaining why I suggested 6 months.

An employer letter is fine and one dated from March should work especially if you have some pay stubs from March until interview. You could certainly do that as a combination as well.

Is this for the I-134? What you have is more than okay for that. :)

I'm sorry if I make it seem like all or nothing, I just wanted to point out where I pulled the number from.

The 6 months is not an all or nothing thing... If you have 5 months, then send 5 months... Add in the tax returns and letter from employer and you'll be fine. For the 3 years taxes, they (us govt) just wants to make sure you have been filing your taxes... But it is the most recent year and current income is what really matters... Don't overthink it... Just put what you have...
