Affidavit of support France, what incom and actif

Hi everyone,

I am a French and US citizen and have been living in France for over 15 years. I plan on filing a I-130 for my soon to be husband with whom I've been living with for the past 7 years, and I know at one point I'll have to fill out an affidavit of support. My question is, do you guys know what incom and/or actif I am supposed to have in order for my affidavit of support to be accepted ?

Le salaire annuel qu'il faut avoir pour que le "affidavit of support" soit accepte depend sur le nombre le personne sous votre toit.

Par example, si il y a 3 personnes il faut gagner $24,737 par an.

Your French income will not count, unless you can move within the company to a US office; thus, you will need to sponsor your husband on assets (three times the income amount), or have a US based co-sponsor to stand guarantoor for your husband.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The reason is because the I-864 asks for current and ongoing income; if you move from France to immigrate/ return to the USA, then your income will stop and you will no longer be able to support the visa holder/ immigrant.

Actually it states in the instructions of the I-864 that you cannot use a foreign income if it is not continuing in the USA. I am on my phone at the moment but I will find you the relevant page if you cannot. If you do not meet the poverty guidelines via income or assets, form I-864p on the USCIS website, then you will need a joint sponsor. A joint sponsor is someone who is domiciled in the US, is a US citizen or permanent resident, who meets the poverty guideline requirements for their own family plus the immigrant.

You can start the I-130 process without having the affidavit of support in place however, as it comes much later in the process. I do not remember if France is a DCF country but will look that up if another member doesn't chime in with that info.

The OP would be wise to download both the I-864 and it's instruction document from USCIS.gov The requirements are explained there. Also download the I-864p, that will indicate the income needed to qualify.

Unless your current income will continue from the same source after moving to the USA, it doesn't count and does not get entered on the affidavit. Please save us some time and tell us whether your income will continue from the same source after moving to the USA.
