After calling the NVC for our case number, they just emailed us yesterday with it, along with :

The affidavit of support processing fee bill invoice

and

immigrant visa application processing fee bill invoice

The letter is made out to my lawyer saying he is responsible for coorinating payment, etc, etc. My lawyer said that I can send him the money and he will pay online.

If I fire my lawyer, will it speed up the process in order for us to do steps ourselve's?

How do I fire my lawyer and how will it speed up process?

Someone said that it may, but by paying both invoices at once through a lawyer also is fast.

Another thing is the lawyer said that I will need to translate anything that is not in English from this point on, but my friend with a wife from Peru, who is going thru the exact same process, said he didnt have to at the NVC level and everything went fine since the docs are in the language the country is in.

What do you guys think? I think my lawyer will slow us down.

I just got an email from the lawyer and he said he will not send in the payment until he receives all of the items on the checklist that he sent me. Original Docs, translations, etc.

I wont be back in the US for 2 weeks and it will be 3 weeks until I can get him all of the docs translated.

I feel he can make the payment now, without the docs and then when I have them send them in. Should I just fire him?

I feel he is an anchor and I can do this all myself.

Please help.

You can definitely pay the fees yourself online, as long as you use a US bank account. You only need your case# and your IIN#. You DO NOT need to translate any of the civil documents if they are in either English or Spanish languages.

It already sounds like your lawyer is giving you bad information and slowing you down. I keep hearing of people complaining about their lawyers not moving at the pace desired. Sometimes it is understandable because a lawyer may be handling several cases at once, they also wait for written notifications from NVC instead of calling to find out; then other times it seems some lawyers just sit on the cases for no reason. If your IR-1 case is pretty straight forward, then go ahead and do it yourself.

Simply demand the attorney to pay the fees. GIve them your bank info.. (the paying of the fees can be done by you , your attorney can not stop you from doing that. )

Getting rid of attorney is matter of you and thier understanding and current relationship with them. if you signed attorney hire (Service) document then you probably need it review by some legal expert. or other wise request them that you dont wnat thier service and you will handle the case from here.

I did that when my attorney filed wrong forms and delayed my case for 3 months in 2009. I had paid him half of the fees and half was left. I choose to not use his service and do thigns on my own. i didn't pay him the remaining payment and he was ok with it.

if you are away from US then paying fees wil be one thing you can do and may be fill ds260 online when it is available. You will have to sign the AOS documents and send proof of income (w2, taxreturn and other docs which might be needed). so unless you have those docs with you and will be mailing them from out of country there is not much your attorney or you can do.

ALso i will share my recent experience with you. I have a friend who was assigned a case # in March. His fees were paid end of mar but attorney refused to send his documents and fill DS260 till he collects all the documents in English and Native language and get Police clearance. He had everything but police clerance.. so i took him to his own attorney and requested them to send in AOS and all IV Civil Documents.. and i told them if there is an RFE for police clearance certificate then we will deal with it at that point. My friends wife had put in application in India for the PCC like 3 weeks ago. If attorney really cared and send in the documents beggingn of april when my friend had all the documetns case would have been closed...:)

so attorneys don't really care about the speed ... you will have to keep up with them and keep bothering them...

I see, thank you both for your responses. So heres the plan.

I am going to go online, pay both invoices, cancel lawyer, send in AOS and IV packages and wait for case complete.

What forms do I need to fill out? Choice of Agent form? Is there something else since I will be firing my lawyer?

Sounds like a good plan. Call NVC right away and tell them you want to remove your lawyer and appoint yourself or your spouse as the agent. I'm not sure exactly what you need to do but the NVC reps should be able to tell you if you need to send an email or other instructions to make this change.

Please let us know how this works out for you. We are also considering removing our lawyer as he moves too slow. We are awaiting for our case to arrive at the NVC so we think this is the best time for removal.
