Found out my husband had been lying to me in the middle of Interview.

Great... another VJer who closed her account because of jerks on the forum. You people are ridiculous to think you're "high and mighty" because you want everyone to believe everything is picture perfect for you and because you're suffering inside, so should anyone else. I hate what VJ has turned into.

Why not just get your GC and then file for divorce? You don't need him to remove your conditions in 2 years. Just move on and leave the loser behind. Since the process is about to finish, you may as well get the GC and move on with your life.

It's not Visa fraud. She entered into the marriage with good intentions.

Why are you people on visa journey so hell bent on having every person whose marriage falls apart leave the country? It seems like you people here on visa journey seem to think that marriages that work out are the only grounds for a green card. WRONG.

OP, you do not "return" your green card and leave. You file for removal of conditions at the end of 2 years and you can stay if you want. You don't need to leave just because you divorce. Just make sure that you fill out the proper paperwork when you remove conditions and get ready to prove that your marriage was a "bona fide" one.

Why not just get your GC and then file for divorce? You don't need him to remove your conditions in 2 years. Just move on and leave the loser behind. Since the process is about to finish, you may as well get the GC and move on with your life.

If the OP divorces after she gets her GC, she has to file for ROC immediately after the divorce, not wait 2 years to do so.

And divorcing in such a short period of time after GC, will raise red flags with USCIS, questioning the validity of marriage.

Everyone is on the OP's side. No one is accusing her of fraud. The OP does not have a GC. Some people were confused about that. OP wants to go back to F1 status.

No one is telling her to leave.

The fact is that the "entering a marriage in good faith" bit only works for those who have Greencards already. OP does not have a Greencard, and while she did enter the marriage in good faith, she cannot get a GC based on that alone. Her marriage must be vital and must exist at the time her GC approved as well. She also needs the original petitioner to be the main sponsor.

The fact that her marriage might dissolve puts her in a precarious position. She can't decide to end the marriage but get the GC too.

Too much stuff is up in the air for her to have any real path forward, at this point. When something changes, one way or the other, then she can make plans.

OP didn't indicate why she closed her account.

Reading through this thread, I don't really find anything particularly ridiculous, other than statements such as 'get your green card' when OP clearly said she wanted to terminate the AOS process. No one told her to leave the country; wasn't even implied anywhere.

I'm kinda thinking, based on some of the things OP has written here, that she got very upset over a lie which came up during the AOS process which kinda put her in a period of reflection and maybe now she's starting to think things through and perhaps come back around to her marriage.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Oh come on.

He lied about something asked on the I-130. And he lied to the gov. Cheating is not on the I-130, so is less bad than what he lied about. OP's English isn't perfect, "fatal" might be a mistranslation.

Point is she was asking how to stop the green card process and obtain a new F-1. My response was to just go with the green card but if for her personal reasons or morals she did not believe that was right that is her decision, the one she has to live with. To try to judge why she wanted the divorce or to guess what information he lied about is moot. She was attempting to obtain information as to how to regain her student status so she could finish school without any obligation to her soon to be ex spouse. She did not ask to be judged or to divulge intimate details of her relationship.

I took that as being that the petitioner answered a question on the I-130 with some details he hadn't told the OP but what that could be I have no idea and apparently we will never find out, although she also said that USCIS lost the I-130 so that didn't really make sense.

I'm so curious as to what it was, she ruled out past spouses and children so was it that the OP was adopted or from a country other than what he told her? Those are the only other questions I could see being at all controversial.

I don't know, whether he had petitioned for someone else before (maybe fiance), or how he obtained his citizenship, or what job he had, or how old he is, maybe.
