CNA I APPLY B1/B2 VISA AGAIN?

immigration form I-867A is basically the record of what happened/ why your tourist visa was canceled. It looks like your you were removed and the visa was canceled because they were not convinced you wanted to just be a tourist; they thought you wanted to immigrate.

What exactly happened? You CAN re-aply but you msut overcome this issue first. For example, did you stay close to 6 months and then only outside the US for a short time before trying to enter again? Did you have papers with you such as a resume or professional certs that made them think you were seeking work? Dod you talk to the immigration officer about having a girlfriend in the US?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I WANTED TO GO TO THE UNITED STATES TO VISIT MY BOYFRIEND, FOR VALENTINES DAY . AND, I HAVE TOLD THEM ALREADY. HOWEVER, UPON MY ARRIVAL TO THE UNITED STATES, I WAS SENT TO QUESTIONING, WHEN I WAS GOING THROUGH IMMIGRATION AT THE AIRPORT. DURING QUESTIONING AND INTERROGATION A TRANSLATOR HAD TO BROUGHT IN DUE TO MY LIMITED ENGLISH, WHICH CREATED A LANGUAGE BARRIER. THE INTERPRETER SPOKE MANDARIN, NOT CANTONESE, WHILE CANTONESE IS MY NATIVE LANGUAGE, WHILE MY MANDARIN IS NOT GOOD AT ALL. THE CAPABILITY TO EXPRESS THE ANSWER TO THE QUESTION ASKED BY THE IMMIGRATION OFFICER, CREATED PROBLEMS AS IT NEEDED TO GO THROUGH A TRANSLATOR FIRST WHOM SPOKE MANDARIN NOT CANTONESE. AFTER SERIES OF QUESTIONS, IMMIGRATION OFFICER TOLD ME THEY CANT ALLOWED ME TO ENTER AND HAVE TO CANCELLED MY VISA. MOREOVER, THEY THOUGHT ME THAT I WENT TO WORK AND EARN MONEY THERE. THE IMMIGRATION OFFICER TOLD ME, I CAN REAPPLY FOR THE VISA UPON MY RETURN TO HONG KONG.

First time I went to USA OCT,2012 and stayed 10days

Second time is on Feb,2013 and stayed 3months

Third time is on May ,2013 and stayed 6months

Forth time is on 13Feb2014 but I cannot enter United States

I want to apply for the visa again, and the officer have said that it allowed me to apply it too. But, in the form(Record of Sworn Statement in Proceedings under Section 235(b)(1) of the Act), it said "you may be barred from re-entry for a period of 5 years or longer". I don't know the meaning about it. May you explain more for me, please?

officer ask me" do you understand that your request to withdraw your application fro admission into the US has been approved ?"

I answered YES

You spent too much time in the US. From your dates it seems that you spent almost 9 months of 2013 in the US.

Be honest with youself and answer a question: who can afford such long vacations in another country?

IMHO CBP officer was suspicious about you abusing a tourist visa.

Do you realize you stayed 3 months (I assume you left April 2013 and turned right around came back in May 2013 and stayed 6 months. So in a one year period you stayed 9 months 10 days.

It's been a year since your last visit. Now you can try and return. But you really going to have to show you have something to go back to. saying you have a girlfriend here and you have shown you can stay indefinitely doesn't bode well for you.

How has your situation changed, seems like you spent most of 2013 living here.

Timeline

You can re-apply, but that does not mean it will be approved. If it is approved, that does not mean CBP will let you enter the US. You have been using a tourist visa to live in the US. That is not the purpose of a tourist visa. If you want to live in the US, then look into getting a visa that will allow you to do so.

You were rightfully denied entry because you were abusing your tourist visa privilege to live in the US.

You can reapply to your hearts content.

They probably thought this time you will try to adjust status by marrying your boyfriend. In 2013, you were here most of the year. They probably didn't want to give you that chance, so they denied entry.

You abused the visa anyways.
