Hi,

I am new here. I am a bit confused of what form to use for filing. Let me give you an insight of what my circumstances. My husband and I were married in Illinois last September of 2009, had my permanent residence card, employment authorization card(never work during my stay) Illinois ID card, social security number. Only stayed in Illinois for 10 months before moving to Australia because husband had opportunity to work here in Australia but due to cancellation of job last year he returned to US but I have to stayed to finish my course. We bought a house in Florida where he is staying now with a part time job( finger crossed will find a full time one). Now my question. I am a bit confused because I encountered to form that can be use for filling. The IR1/CR1 Spouse visa and K3 . I will apply re entry by June hopefully just in time to finish my course in July. Any input of what to do very much appreciated.

Thanking you all in advance. Cheers!

Rachelle

hi

K3 is almost obsolete, so he will file the i130 for the IR permanent visa, it will take a year or over a year, so he can file the i130 and G325A, and he should as soon as he can

yep forget the K3 and when you do your police check for Australia I think the validity is 1 year (just so you don't have to pay for it twice) it seems that the first stage of processing varies quite a bit so maybe keep in mind no set rules with time, good luck with the study!!

cheers
