Hi Friends,
I need a big help from you. Sorry for a lengthy post. Waiting for suggestions.
My employer had filed H1B VISA this year. I don't know the lottery results and even my employer will not reveal that till July. Even though selected in lottery, I have no hopes that my employer will send me as there are bulk of applicants from my company.
Going to US is my dream
So I planned to study MS in US. I got admission in 4 colleges for FALL 2014 which will start in August 2014
Questions::
If not selected in lottery:
  1. Can I attend F1 interview in July?
  2. Will Visa Officer(VO) know about by H1B application?
  3. If VO knows, what is the best way to answer why did you applied both at a time?
  4. Will VISA officer reject me straight away stating me as potential immigrant saying you had applied for H1?
  5. What we need to fill for the Question in DS 160 form for F1 Visa "Have you ever been refused a U.S. Visa, been refused admission to the United States, or withdrawn your application for admission at the point of entry?"
If selected in lottery:
  1. Still can I attend F1 interview in July?
  2. Will Visa Officer(VO) know about by H1B application status(i.e. it was picked in lottery)?
  3. Do I need to cancel the H1B process before trying to apply for F1 VISA? If so It's not in my hands. What to do?
  4. If I can attend F1 Interview, what is the best way to answer VO why did you applied both at a time?
  5. What we need to fill for the Question in DS 160 form for F1 Visa "Have you ever been refused a U.S. Visa, been refused admission to the United States, or withdrawn your application for admission at the point of entry?"

Please provide your valuable suggestions.

If not selected:

1. Yes

2. Yes (assuming your name is part of the app)

4.They won;t reject you straight away, but you will definitely need to prove strong ties to home/ reasons you will return.

5. Not being selected by your company for a visa does not count for this question, if that is what you mean. If you ARE selected by your company but then the US embassy refuses you a H1B for some reason, then you;d need to answer yes.

If selected:

1. Yes, though it will raise questions

2. Yes

3.No; until you have a visa in hand, you can proceed with both apps.

4. The truth. Ie in this case, why would you prefer to be a student and not be able to work over a solid work visa which could lead to a greencard eventually?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I'm not an expert but I recently had a somewhat similar question to ask my International Students Advisor at my school. My question was specifically about getting a work authorization attached to my F1 (optional practical training) at the same time as submitting my application for a green card interview (diversity visa winner). He said he sees no problem with it, and that there are a lot of people who apply for the H1B and the F1 visa at the same time and get the F1 even if they showed dual intent, so I don't think you should worry about #2 in any case. Just tell them the truth, and make sure to emphasize that you would not remain in the country illegally, that your dual intent refers to being here legally, and that otherwise you have very good prospects to return to your country after graduating with your M.S. Good luck!

DV-2015 Selectee - Case Number EU30,7xx - Interview estimate: May/June 2015 (?) - Might try to do AOS though it looks like it might be worse this year
