I-751 was filed in early October. Wife (applicant) are separated, and while we are on civil terms, I'm not in a position to ask her the status of her application. I'm pretty sure she would have told me if she had gotten anything, whether the approval or RFE. But I don't have the receipt number so I can't look it up.

We submitted no evidence with the I-751, so it seems almost impossible she'll just get the 10-year GC. We listed the same address on the I-751 because at the time we signed it, we were still living together.

We we're 7 months out here. She should be the one worrying and anticipating what might happen, but she is unconcerned.

What I want to know is, how long can USCIS go before she hears something? Not what is the "theoretical" maximum but in practice, what is (say) the 99th percentile?

There is in fact one practical aspect to this, which is that she will be away for 6 weeks in June and July and won't see her mail. But mostly I'm just wondering when to expect that this will all come to a boil.

If you can't ask her about status and don't have receipt #,how do you know she did not hear anything from them?

It depends on your service center too,VSC delays application as compared to CSC.

It differs from case to case, since you did not submit any evidence, its gonna be difficult to get approved early and easily.

Your wife should be more concerned about it than you.

I talk to her frequently and if she had heard something, I'm sure she would have told me.

I don't know which service center. Filed in VSC but I have no idea if it was moved.

OK she should be. But she's not. Mostly I am trying to anticipate when she will hear something, which she will necessarily blame me for. Because in her mind, she has done everything perfectly and the only possible reason she could be denied is if I subvert her.

It would be nice if someone would actually try to help with the information rather than quibble with why I'm asking.

But to make you happy:

1) I am interested in the timeline because when she gets any action other than an approval, it will probably flip her out. She will probably blame me for her non-approval, and will also be relatively clueless what to do about it. I want to anticipate when I need to be ready to react. Also, she will be away for 6 weeks in the summer and may not have access to her mail.

2) I can't ask her because she will take any interest on my part as a sign I am trying to subvert her application.

We did sign the joint ROC and then separate.

The October timeline thread contains numerous reports of approvals, RFE's, and interviews. But knowing what has happened to others doesn't give me a handle on what will happen in this case.

IIRC the I-751 was submitted with no supporting evidence whatsoever. I'm really not sure why we did that. Perhaps it was because I didn't research it enough. Perhaps it was because we were fighting viciously at the time and I just wanted it filed. Perhaps it was because we had a relatively easy time in prior stages. Perhaps it was because after getting all the prior stages approved without living together, we thought this one would be easier now that we actually were living together. (To be precise, we signed it jointly while living together, but filed it after separating. I sent it in before I moved out, but it was returned for insufficient postage and my wife remailed it after I had left.)

It seems like since normal processing time is 6 months and we're at 7 now, and so many others have received some sort of action, my wife should hear something very soon. But I would have thought that in March, and in April.

If you sent it with no evidence, I am surprised they even accepted it. Either way, your wife will likely receive RFE and if she fails to submit evidence, she will be denied. Given the situation the way you described it, I think you will have to be prepared for her denial.

The longest time for USCIS to respond I have ever seen is about 1 year 2 months. Then if she receives RFE, add another month on top of it.

Your wife will get RFE for lack of evidence. She will also need to change her ROC to something else, like divorce waiver. She may have the RFE already and be lying about it.

The RFE comes at the same time that an approval would have come. That is the first time they look at the case, if good, approve, if not good, RFE.

Yours sounds not good.

Neither of us has even filed for divorce.

Every time she get something she doesn't understand or care to deal with, she refers it to me. An overdue property tax bill, confusion over her condo fees, money transfers from her country of origin, she has me handle them all. It's unimaginable that she would get an RFE and not tell me. Especially since she would have to come to me for documents.

If you still want to live with her, want to work out relationship then only you should be concerned about her feelings.

Its difficult to understand why should it matter to you whether she is able to remove condition or blames you or not for it.

I think if you don't plan to be with her anymore then you should move on with your life.

Because your not living with her and concern about her CR raises question of bonafide marriage on your part.

I just checked the October thread and some people haven't gotten anything yet, so it's feasible she hasn't either.
