I-134 and I-864 question

Hi! I have a question about the affidavit of support requirements. My income for last year meets the 125% requirement, but the previous two years do not. My questions in a nutshell are:

1. Will I need a co-sponsor for the I-864? I'm assuming so, as only last year's income was sufficient.

2. Will I need a co-sponsor for the I-134? It appears that I only need to prove meeting the requirement for last year, so it appears that I'm fine without a co-sponsor for this?

You seem a bit confused. The I-134 is not about proof of meeting. That is the I-129F petition. The I-134 is the affidavit of support used for the K-1 visa. The I-864 is used later, after you are in the US, married and you file for AOS.

Current income is most important and what is used on the affidavits, not past income. If you are not self-employed, then along with a copy of your most recent tax transcript, provide a letter from employer and/or most recent pay stubs to prove your current income.

Thank you for the responses! My main concern was that on part 6 of form I-864 they want me to list my income for the past three years. The first two of those three years do not meet the income requirement, and I was wondering if this would count against me.

However, if I am understanding correctly, my current income is all they will be concerned with financially, and the previous years are just to show I file my taxes. This means I don't need a co-sponsor. Thank you again!

They look at the overall situation of your case, but current income is most important. Being above the requirement for last year and currently will work for the I-134, and later for the I-864. Use the same evidence for both, the most recent tax transcript, letter from employer and/or recent pay stubs. Listing the last 3 years on the I-864 form is a requirement, but only the most recent tax transcript needs to be submitted with the form.

And I apologize for my previous reply. I was obviously the one that was confused and apparently read your post wrong to begin with. Glad you got the information you needed from it anyway. Good luck!

Regarding the I-134, this is what it says, verbatim, in the packet three information the beneficiary will be sent: "Evidence of support: evidence that will show that you and your children, if any, are not likely to become public charges in the United States. The enclosed information sheet, Evidence which may be presented to meet the public charge provisions of law, lists evidence that may be presented to meet this requirement of law. If an affidavit of support is to be submitted, I-134, Affidavit of Support, should be used."

I filled out the form and sent this stuff in: the last 3 pay stubs from my job (I get paid once a month), tax transcripts for the last three years, including 2013, a bank printout showing just my deposits for the last year, and a letter from my employer. I'm sure it's overkill, but I would rather be over-prepared than under-prepared.
