Hi Team,

This is my 2nd visit to US from a US based MNC for KT and Trainings. Earlier when I 1st visited US in 2012, At Port of Entry I have mentioned that I would stay for 2 months and stayed for 2 months ( i 94 was given for 6 months).

This time in 2014 at port of entry , I mentioned that my KT and Trainings would be for 3 months and ( i 94 was given for 6 months ) , but my company has extended my stay till the last day of I 94 as KT and Trainings were not completed.

Will there be any problem for me , If I stay for 6 months on B1/B2 ?

Please help me out.

Thanks,

Varma

You can stay until the end of the visa valid date... But do not overstay (leaving the day of expiration is a bit risky IMO, if there is an issue with the flight then you are in overstay)...

10/14/2000 - Met Aboard a Cruise ship

06/14/2003 - Married Savona Italy

I-130

03/21/2009 - I-130 Mailed to Chicago lockbox

11-30-09: GOT GREEN CARD in mail!!!!!!

Citizenship Process;

1/11/2013: Mailed N400 to Dallas Texas

3/11/2013: interview.. Approved

If you were given 6 months at POE, then you won't have any problems as long as you actually leave by the expiration date written on the I-94. No more training extensions ;)

Edit:

But do not overstay (leaving the day of expiration is a bit risky IMO, if there is an issue with the flight then you are in overstay)...

This is a good point. You should try to finish things a few days ahead of time so that any unforeseen travel delays don't causer an overstay. With only a couple off days, you wouldn't trigger any sort of ban but it could cause you future issues with visa issuance.

Thanks for the info Guys...

I have been given I 94 from from Jan 15 - Jul 15 and I am planning to return on Jul 13 2014 to India. What do you suggest ?

Will there be any problem for my further B1/ B2 travels ( and at port of entry's next time ), If I stay for 6 months this year ?

Will this affect my l1 or h1 ? Do I need any documentation from my employer regarding my 6 months stay ( i:e trainings schedule etc ) as I have told in port of enty that my tranings would be completed in 12-13 weeks.

Thanks,

Varma

No, no problem... But keep in mind there is a time that you need to remain outside of the USA (you cannot just turn around and re-enter the USA as you cannot LIVE in the USA on a tourist visa... But other than that your future visa visits should.not be affected... As long as you do not overstay...

Not so sure, I know there has been a crackdown on particularly Indian IT contractors confusing KT/Training and Working.

You are allowed to stay in the US until the very last day shown on your I-94, provided you observe the conditions of your visa. No problem there.
