Hi everyone,

I was doing some reading on travel.state.gov and I'm getting a bit worried our application would be denied based the likelihood of my spouse becoming a public charge. I honestly don't think he will become a public charge in the US though I feel like immigration might think he will.

Under this section it says factors that will be taken into account are:

1) Age. I'm 22 and he's 20. Most would say we are pretty young and therefore more likely to become a public charge.

2) Health. Not worried about that. Something where age helps. Both of us are in good health.

3) Family status. Can someone clarify what this means? I'm guessing whether or not we are married. Which we are.

4) Assets, resources and financial status. Not looking good here. I have a few thousand dollars saved up, own no property (I rent) and I am a student with student loan debt (though my parents pay my tuition and have agreed to pay off my loans). Had a job before but I'm unemployed currently (hoping that will change soon). My partner is on welfare here (centrelink) which pays an allowance to students who are studying in university. Will they deny him because he is on welfare now? It's pretty common here for students in Australia, unlike the US. I myself (the petitioner) have never been on welfare.

5) Education and skills. A bit worried here too. My partner is currently trying to get his HSC in university because he wasn't able to graduate due to adverse circumstances. He also has only had one job in fast food so he doesn't hold much skills. He wants to work a sales job in the US to save up to study IT. I on the other hand am finishing up my university degree within a year.

BTW, we ARE getting a cosponsor (because we have to). His uncle who is a US citizen (also married to an Australian) and a major the US Army is co-sponsoring. He comfortably makes the income requirement (O-4 payscale: approx $72,000/year) and owns quite a bit of land and other assets.

Based on all this do you think he'd get denied on public charge grounds? Or will having a cosponsor be enough to override our shortcomings?

Addressing each point would be appreciated. Thanks in advance!

You have a co -sponsor whomsays that IF you apply for means tested benefits that THEY would paynthe Govt back... None of the other ####### you listed matters matters...
