:help:

I am a US citizen living in Argentina and recently got engaged to an Argentine. Ideally, we'd like to get married here in Argentina next year, and then have another wedding in the US. We'd like to eventually move to the US, and I'd like to know how to go about the visa application process, etc.

How do I go about all of this? Is it easier to just get married in the US first and then in Argentina? I am absolutely clueless on what needs to be done.

Any advice or suggestions would be greatly appreciated.

Thank you!!!

Try reading the guides above. If you wish to marry and reside in the USA you will need to go the K1 route. But you will not be able to marry in Argentina as the visa is only good to marry in the USA. I guess it depends on where you would want to reside after you are married. Hopefully someone can be more helpful as my only knowledge is the K1 way because thats what i did.

Margaux,

It might help you to think this thing through if you were to recognize the difference between 'wedding' and 'marriage' and not use the two terms interchangeably.

- A wedding is an event, the event may or may not create a marriage depending on the laws of the jurisdiction where it's performed.

- A marriage is a legal state of affairs, what creates it depends on the laws of the jurisdiction where it's performed.

If you used the terms in this way in the first paragraph of your post, then a K1 visa is not what your fiancee needs - she will need an immigrant visa (IR1 or CR1), a K3 non-immigrant visa, or perhaps both.

If you reverse what you wrote, and want to have a wedding in Argentina followed by marriage after coming to the USA, then the K1 is what she will want - as long as having a wedding ceremony does not create a marriage under the laws of Argentina.

If you're living in Argentina with your fiance and you want to get married there go ahead... but then you'll have to apply for a K3 visa before you can both move back to the US.

A K1 is for people who are living in the US and who want to bring their fiance to the US to be married.

Karen - Melbourne, Australia/John - Florida, USA

- Proposal (20 August 2000) to marriage (19 December 2004) - 4 years, 3 months, 25 days (1,578 days)

STAGE 1 - Applying for K1 (15 September 2003) to K1 Approval (13 July 2004) - 9 months, 29 days (303 days)

STAGE 2A - Arriving in US (4 Nov 2004) to AOS Application (16 April 2005) - 5 months, 13 days (164 days)

STAGE 2B - Applying for AOS to GC Approval - 9 months, 4 days (279 days)

STAGE 3 - Lifting Conditions. Filing (19 Dec 2007) to Approval (December 11 2008)

STAGE 4 - CITIZENSHIP (filing under 5-year rule - residency start date on green card Jan 11th, 2006)

*N400 filed December 15, 2011

*Interview March 12, 2012

*Oath Ceremony March 23, 2012.

I think a K3 is far better than K1 in so far that it reduces most bureaucratic processing that the K1 still have to go after arrival here. But the DCF filing is great. If its available and you meet the criteria go for it! Good Luck

Margaux,

If you are legally resident in Argentina, then I agree: DCF/Direct Consular Filing is the best thing since sliced bread.

My husband and I married overseas, where we were living. We investigated the Consulate's website for our area and found out how to petition directly with them (3 days' wait) and then applied for an Immigrant Visa (CR-1 for newlyweds).

When he came to the US with me, he became a Permanent Resident immediately and his Green Card was mailed to him directly. Our total processing time was 33 days.

Learn about What is DCF? here: http://www.visajourney.com/forums/index.php?showtopic=2939

this is the info from BA:

US citizens legally residing in Argentina and some US citizens marrying resident Argentines may file a petition at the US Embassy in Buenos Aires."
