Hello everyone,

Ok here are my details:

K1 Visa issued 12-24-13

Fiance entered the US 2-11-14

Visa good until 6-24-13

Marriage 4-18-14

Placing AOS package in mail 5-8-13

So we married before the 90 days, but somehow I feel like we are losing time and only have a few days. My husband went to apply for a Ca ID and they told him his I-94 was about to expire and did not allow him to get his ID, but he did apply for his Social Security and it will be here in 2 weeks. Am I being paranoid, Im sending his packing via Priority with signature confirmation to the physical address in Chicago. Is there any reason for me to be on edge about mailing this AOS today.

All advice and comments as well as suggestions are greatly needed and appreciated.

Visa expiration date is meaningless after POE event.

There is no deadline to send in the AOS.

The deadline/timewindow only exists for when to get married, and that's 90 days.

The I-94 will expire in that 90 days as well.

So if you added in the I-765 and I-131 (filing fees are waived when filing with the I-485) then he can expect a combo EAD/AP card within 90 to 110 days from filing - and it's THAT card, that he can use, to get a CA ID. K-1 visa holders with an I-94 are turned away, many times, at that office, if that's all they can show.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Darnell is correct so hopefully you applied for everything in your AOS packet. We did and it went smoothly and your husband will be basically in limbo until he can get his EAD an I.D. We're in CA and we didn't apply for an I.D. but got her learners permit so she could practice driving and get her drivers license. We applied and got here provisional SSN with her I94, most people don't do this and some offices wont allow it but ours did. I agree with send the packet with tracking, letting you know where it is at and if it's been delivered. You never know if you mail will end up on a FEDEX truck crashes and burns up on the highway and it will give you some peace of mind once you get the notice of delivery.

Good luck on the process.

Copy of license and certificate of marriage (unofficial, cause we are waiting on the original to come in the mail)

2 passport pics with name and A number

Copy of receipt for SS number

I will be sending in my supplementals (new ID & drivers license with married name & SS Card)

Really I hope that Im not missing anything. I think they were looking at the "LAST DAY TO ENTER THE US" which is 5-11-14.

You need to submit a total of 6 pictures. You missed the DS-3025 (Vaccination sheet). Also, if I were you, I would wait for the official (or certified true copy) marriage certificate. Some have been given an RFE for not submitting an official marriage cert.

What evidence did you attach with the I-864?

You also need duplicates for the other requirements for I-765 and I-131.

When you have NOA1 of I-485, then you can come back to obtain ID.

New Journey AOS:

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

does that work in California? I am uncertain.

I highly doubt too that it will work in CA. Doesn't work in New Jersey, for sure. Have to wait at least for my EAD/AP card, so they said.

You need to submit a total of 6 pictures. You missed the DS-3025 (Vaccination sheet). Also, if I were you, I would wait for the official (or certified true copy) marriage certificate. Some have been given an RFE for not submitting an official marriage cert.

OK, whew! :dance: Thought you went to mail them out already!

Yes, 2 pictures for each applications (AOS, EAD, AP) = Total of 6. Do you have a copy of the DS-3025? It's highly advisable to submit a copy of this with the AOS, as some have reported here that uscis misplaced their medical files.

For the I-864 attachments, include ITR and W-2 (or just the IRS transcript).

EAD & AP have their separate set of requirements, which are similar to AOS. You need to make duplicates of these required docs. The requirements are listed in the links I sent you above. :)

Made the process really really easy.

Please keep in mind that some dates are only known after receipt of another document.
For example, the USPS Form 3811. The stamped receiving date was not know until the original Form 3811 was received on 07/13/2013 1:30 p/m CST.

I applied for my Nevada id end of April and my k1 visa runs out the 25th of may. they only gave me an id until then.

So once i have proof that we have applied for aos they will give me a proper id that doesn't expire for a few years.

I think the reason is incase you don't get married and try to stay illegally you will have a valid id.

The other comments are correct. There is no correlation between the expiration date of the K-1 Visa and the AOS. My fiance received her visa Nov 3, 2013 and it expired May 3, 2014. She arrived here in the USA Feb 12 and we married April 12 so only 60 days for the marriage. I sent her I-485 app and her EAD to Chicago on Sat 26 by express mail with signature confirmation. It was received on April 28 (Monday) and I got a copy of the receivers signature by email from the USPS. However, it is now May 8 and still no confirmation that the documents have been received nor have they cashed my check for payment. The UCSIS site says Chicago receives 1000 apps for I-485 per week so I guess it takes a bit. The same site also says right now its taking 10 month to complete the process. They are just completing apps from July 1, 2013.

Id be curious if you get a faster reply than I have so far. Oh and BTW we did the electronic notification form too but so far nothing.
