Hello,

I hope somebody has an answer to my question in this forum. My foreign born fiancee studies in Moscow, Russia as an international student. Given that she has lived there for 6 years she will need to get a police certificate from Russia as well (K1 visa interview prep). Where do we address to get this piece of paper? Is the school supposed to give it? My country's embassy in Russia or I have no clue. She also went to the Ministry of Internal Affairs' (MVD in Russian) office, unfortunately nobody knew how to help her there either.

Any help is appreciated.

03/07/2015- Got married!

03/26/2015- Mailed off Adjustment of Status, Employment Authorization Document & Advanced Parole

04/06/2015- Personal Check cashed, electronic NOA1 for all three

04/13/2015- Received NOA1 hardcopies for all three dated 4/3/2015
04/18/2015- Received NOA for biometrics appointment dated 4/10/2015

04/28/2015- Biometrics appointment in Houston

You go to the police force that has jurisdicion where she is.

Typically the large city police forces have established systems for this. You follow their system and should expect no trouble,

Thank you very much for your response. I just talked with her. She said she was told (at the police station) that our embassy in Russia handles this. I have never heard such a thing. Embassy doesn't handle police record certificates, does it?

Nope, russian police certificates are issued by local police, not embassy.

Maybe the police department sends it directly to the embassy. That I heard of. But the embassy gets it for you? Nope.

Go to the website of the police department in that city and see what it says.

To clear some things, police certificate is either requested at LOCAL police station or through gosuslugi website, and you have to go there to pick it up personally. You will be notified when it is ready to be picked up either by phone call (if you request in person) or mail/email if you request through gosuslugi.

They are not mailing to embassy and it is suppose to take 30 days from request to have it ready, but it has been known to take more (2 months)

Always double check your documents and forms. Not only do you get delayed by RFEs and Checklists, but the time it takes for them to review the new items you send could be used to approve more applications. Save yourself and others valuable time!

Current Status: NVC:
-Assigned and Received NVC Case Number, IIN, and BIN April 18, 2014. (100% sure case # was assigned today because I called twice and it wasn't assigned in the morning when they opened but in the afternoon it was)
*Could not provide email then as case was still being updated in their system
-On April 21, 2014 I was able to provide my email and beneficiary's.
-On April 28 I was able to fill out DS-261
-On April 29 I received and paid AOS Fee (at 1pm)
-On May 1 I received and paid IV Fee (at 1pm [became available]), also AOS Fee shows as PAID
-On May 5 IV Fee shows as PAID and DS-260 became available and was completed. Also, AOS Package Scanned by NVC

-On May 7 IV Package Scanned by NVC

-On May 28 AOS Accepted

-On June 2 IV Accepted/Case Complete

-On June 11 Interview Email Received

-On July 3 Interview at Moscow

Note: Medical Exam scheduled after interview letter received by calling the specific clinic, earliest appointment was 2 weeks ahead)

-Visa approved, came to us, got greencard, sadly things didnt go well and divorced. Last I hears she was still in the US and got a full greencard (I notified USCIS of divorce though)

Uh oh. I didn't realize my fiancee would need one extra police record for when she lived in different country. She is From Baku, Azerbaijan but she studied in Moscow, Russia for 6 years. she would come to Baku as often as every 2-3 month. She just got PC in Baku no problem. next day. Free too. Does she really need one from Russia? and no way to do it on distance? :( Darn :(

Police and Prison Records

Available. Russian law (MVD Order no. 965, dated November 1, 2001) mandates that the Ministry of Internal Affairs (MVD) provide police certificates both to Russian citizens and to foreigners who have lived or are living in Russia. The law states that in Russia, MVD offices must provide the certificate within 30 days of application. Those residing outside of Russia, both Russian citizens and non-citizens, may either delegate a Power-of-Attorney to apply for the certificate on their behalf in Russia, or apply directly to the Russian Consulate where they reside. Police certificates should note all names that the person has used in Russia, and should note the MVD branches in all locations that were queried.

Federal and more serious criminal records in Russia are kept at the Main Information Center (MIC), while convictions related to minor offenses (interpreted as when the punishment was up to 3 years of imprisonment) are stored in the local police (militia) archives. Court records are generally available upon a request from the individual. Prison records are generally not available.

Under Russian law, a prior conviction is listed as "expunged" in the MIC's databank after a specified period of time has passed following the completion of the sentence. For "grave" crimes the period is six years; for "especially grave" crimes it is eight years. On November 7, 2011, the Russian Ministry of Interior issued Ordinance No. 1121, requiring a new format for police certificates that includes the notation of expunged records. Thus, if an applicant committed a grave crime and more than six years have passed since the completion of his/her sentence, a police certificate issued prior to November 2011 will not show a record of this crime.

Yes, if you are not residing in Russia, apply to get police certificate at the embassy. It might take some time (a month or more) though.

It says so on the Russian gosuslugi site:

Сведения о наличии (отсутствии) судимости по заявлениям граждан, находящихся за пределами территории Российской Федерации, предоставляются через Министерство иностранных дел Российской Федерации.)

Police certificates for people that are outside of the territory of Russia are provided via Ministry of Foreign Affairs (i.e., embassies)

Awesome! Whew. I was worried about it, My fiancee would have a chance to swing by Moscow in a couple of weeks but she wouldn't be able to stay there for a month(maybe more) to receive it. and all the pain with Power of attorney. bluh.
