My husband is a Moroccan citizen. He came here in December of 2013 and his K1 visa is now expired. We have filed for adjustment of status at the begining of March and have been approved for advanced parole. We just recieved two documents in the mail.

Two of our good friends are getting married on a cruise in Nov of this year. It looks like the Oklahoma City office is behind on processing times for AOS and most likely my husband we still not have his green card by Novemeber.

My question is this, has anyone gone on a cruise with an AP document before? Did border patrol have any issues with that?

The cruise is to Mexico, Cayman Islands, and Jamaica. I looked into each one and it looks like they do not recuire visas for cruise passengers, so my only concern is getting back into the US. I'm feeling a bit paranoid about that. The last thing I want is for him to be denied rentry because he didn't leave the US for "urgent humanitarian reasons."

Anybody who can help set my mind at ease it would be much appreciated. We really dont want to miss our friends wedding or we would have just waited until he had he green card to leave the country.

It does not have to be for humanitarian reasons, as said above AP is to re enter the US before GC. I have used mine twice (not on a cruise) with no issues.

By the way, the K1 expired on entry.

An AP document is all you need for a re-entry to US and as mentioned above, this is what exactly an AP is for. The humanitarian requirement does not apply to your husband or to anybody adjusting from a K-1. http://www.uscis.gov/sites/default/files/files/form/i-131instr.pdf

Just don't forget to bring your husband's passport too though. Have an enjoyable cruise! :dancing:

Not sure if you already booked this, but my husband and I almost booked a cruise with my AP and carnival, princess, and royal carribean cruise lines ALL said I needed to be a "permanent" resident to go on a cruise. As did our travel agent, so I would definitely contact someone from the actual cruise line you are planning on going on. We ended up planning our honeymoon in Dominican so we were safe from any issues.

re: cruise ..

Morocco? check all of the ports of call, see if this country's citizens need any type of visa, whatsoever, to get off the boat.

the AP doc/card will allow him back in the USA, but since he is NOT a greencard holder, is doubtful the immigration control ppl at the ports o call will allow him off of the boat, based on what's IN or NOT IN his passport.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Agreed with Darnell. AP only allows re-entry to US. For non-LPRs or non-GC holders, entry to the country of destination is still dependent on the citizenship or passport of the traveler.

To OP, before booking the cruise, do check with the embassies of those cruise destinations if a Moroccan citizen requires a visa for entry.

To OP, before booking the cruise, do check with the embassies of those cruise destinations if a Moroccan citizen requires a visa for entry.

OP says they have checked and for Morrocans there seems to be no visa requirement. The cruise line will be able to tell them this anyway.

Entry in to any country is likely to be only on the passport, I doubt if there were a visa requirement for any nationality being a GC holder would make any difference. That just tells them where you live, makes no difference to nationality.

It's a just-in-case gentle reminder to OP. Most cruise line staff are foreigners too and won't know (or give 100% assurance) which nationality can go to which country without needing a visa. This information is also not readily available in any cruise line's website. By experience, I was told to check with the embassy of the destination country.

A US LPR can go to certain countries without visa, regardless of the citizenship, like Canada, Mexico and some Caribbean countries. :thumbs:

What reason did you have for applying for the advance parole document? (Just curious, I'm doing my application now, and although I have a valid reason- my father my have to do open heart surgery for the second time, I don't have evidence proving this and I just want the AP 'in case' )

A pending adjustee does not need to provide any reason for applying for AP.

For Part 3, since you have no final dates of travel yet, you can leave it blank and after printing, write legibly (using a pen) "unknown" and "N/A", on Part 3 Items #1 and #2, respectively. As Hypnos said, you don't need to explain why you need or qualify for AP.
