Foreign Marriage Certificate Error

Hello, My situation is that Im Mexican and I'll like to apply for a GreenCard. I got married in Mexico with my wife that has double nationality she is US Citizen (born in US) and Mexican (parents). The problem is that our marriage certificate said that my wife was born in Mexico not in the US. It will be complicated for us to change that certificate. Do you know if we will have a problem presenting our certificate with that error?

All the rest of our paperwork looks fine and in order.

I'll appreciate the help and advice.

That would be illegal.

Not necessarily. Several states permit already-married couples to remarry (complete with a new marriage licence); Texas is one of them. The OP would need to declare their first marriage as the date they were married though, so it won't solve any problems that way.

Somebody asked a similar question last month. He is an US citizen married a mexican woman, and lied regarding his country of birth to be able to marry in Mexico. So the answers can help you.

I am assuming you entered the US via some type of visa and are now wanting to adjust status within the US, since you mention re-marrying in the US?

Yes, I enter with an F-1 visa

You need to find out if you can get the marriage certificate amended. It will be a problem applying for AOS with your spouse as a USC but listed on your marriage certificate as being born in Mexico and not being a USC.
