Timeline

I am putting together my husband's AOS and filling in out the I-864. Trying to add all eveidnece they may want but dont want to waste time and paper with over load of info.

If I list an amount in Part 7 line 3, stock, bonds, certificates and other assets not already included, I listed the amount from my 401k and stock options from work. Do I need to include statements of those accounts??

I did with the I-134 for his K-1 visa but it said to and this form doesn't say to.

Your 401k is not a liquid asset and stock options may or may not be depending if they are vested or not.

If you do have a 401k and stock options though you must easily exceed the 125% of the poverty level so just leave it at your taxable income via your tax transcript for last year.

If your gross income is well and above the 125% of your household size, you don't need to fill-out Part 7 of I-864. Gross income is line 22 of your 1040.

You are going to need a co-sponsor. Qualifying on assets is shaking at best at Lagos and rarely if ever accepted unless you a rich person and can show that money is flowing constantly in.

And you know its 3 times the amount of what you need for your household size? (just asking). But I would line up a co-sponsor. NVC will accept but Embassy highly doubt it.

You are going to need a co-sponsor. Qualifying on assets is shaking at best at Lagos and rarely if ever accepted unless you a rich person and can show that money is flowing constantly in.

And you know its 3 times the amount of what you need for your household size? (just asking). But I would line up a co-sponsor. NVC will accept but Embassy highly doubt it.

I think the OP is just trying to list too much information, if she has a job that has a 401k and gives her stock options then I am pretty sure her income would be well above the required 125% of the poverty line.

LOL, no problem. So many posts and info that your eyes can get buggy. I am above the 125%, I have enough I can also sponsor his daughter just on my wages. My stocks are fully vested and my 401K is vested at about $7,000 with a total account balance of about $12,000. (I started late in life).

So opinion is I dont need to even list it? just send my last 3 tax returns? or just the last year like the form says?

No to the assets, as mentioned above. But you can still include your 2011 and 2012 1040 + W2 (or IRS transcripts, which you can get online), and don't forget to tick the box below that item when you do so. Some people (including me) submit these to provide a harder evidence of continuous good income of my spouse. :)

If your income is enough on its own, skip the assets. Provide a copy of your most recent transcript and then also a letter from employer and/or most recent pay stub(s) to prove your current income.
