Passport photos of each parent -- 2 each.

Income tax returns with W2s would help establish U.S. physical presence/residence. Follow the checklist exactly to guarantee you have all required documents.

I agree with Leatherneck :)

Also it's a good thing you have prepared something for the proof of domicile. They are going to count if your husband have lived in the US for 5 yrs. My child's CRBA got denied because my husband was 4 months short for the 5 yr period. We showed his military orders but they said it was still short of 4 months. So they asked us to mail his school transcripts. It's been 3 weeks since we sent the additional paperwork. I hope they get's back to us the soonest.

Good luck to your interview! Btw, our anniversary date is also April 29 :)

This topic concerns me also.

I am an American citizen, with a 4 year old son born to a Filipina out of wedlock. We just married on May 16, 2014. At the time of my son's birth, I was working in Korea as a US government employee. I had been there for 6 years. I moved to USA shortly after his birth in 2010, but will be returning to Korea again in July. I want my wife and son to join me in Korea, but I want him to have a US CRBA. I'm worried that I will also be denied because I was not physically present in USA for the 5 years prior to his birth. Is there a good way to work around the physical presence issue?

My husband was 6months short with the proof that we gave them even if he stayed at u.s longer than five years. I guess they really based it on the proofs that u provide. Were gonna sub,it additional documents. His mom already send the additional documents here in the phil last may 16 and havent received it yet. I guess they lost it. Too much of a hassle his mom will send snother copies though. Then send it right away at us embassy for additional documents..

Based on what you wrote, you have nothing to worry about. The physical presence is a cumulative of not less than five years, two of those years after the age of 14, not a consecutive five years prior to the child's birth. Besides, US government employment overseas counts as physical presence in the USA.

(g) a person born outside the geographical limits of the United States and its outlying possessions of parents one of whom is an alien, and the other a citizen of the United States who, prior to the birth of such person, was physically present in the United States or its outlying possessions for a period or periods totaling not less than five years, at least two of which were after attaining the age of fourteen years:

Yes the quality of proof is important. You offered proof of more than five years and still did not get the CRBA?

Based on the law, proof of physical presence for a total of five years, two of those years after the age of 14 is what's required. So if your husband was in the USA or its outlying possessions based on the above, and can prove it, you should get the CRBA.

OK then. The next problem is actually being able to schedule an appointment. Everytime I look at the embassy's appointment site, it shows either fully booked or no appointment times available for the next 4 months. How does anybody manage to get in to register the birth of their child in Philippines, especially if the American citizen parent does not live there?

You need to check it everyday. Sometimes a new slot opens. And yes. I waited for four months for crba of my child

{Whistle} Everybody, look here is what American Service Center at U.S. Embassy just proclaim on its U.S. Citizen Service page, also can be seen in its CRBA page:

Quote

Starting August 1, 2014, all appointments for Consular Reports of Birth Abroad (CRBA) and Adult Citizenship applications at U.S. Embassy Manila will be made through a mail-in appointment scheduling system in order to provide better service to our clients. The on-line appointment system will no longer be available. The new mail-in system will reduce the wait time for appointments and help you prepare for your citizenship appointment at the Embassy.

So, we are all back to grade-school days where all line up-to-please-our-teachers and Principal to places such as the caferta or going home. Guess no more first come, first serve walk-in appointment. This is it, mail-In then.

Remember this, pre-July 1st CRBA checklist is now outdated, and this is new revision page. This is shortcut to revised July 1st checklist.

General things in VJ is Do-It-Yourself site which we all would help, giving advices, pointers and tips. I would like to think those law practitioners-for-paid and legal guide (the navigator-for-hired) out there: those who might like us not to perform DIY but letting them do all legal paperworks, pretending s/he know the best route for shortcut or else to apply jurisdiction, e.g. under the table, are merely fable and cannot stop us. This is information age we are living. WE all have same knot to tie, same kind of anxiety, same kind of sweat, of facing judgmental day whether CO grant our visa or not. If you do what we did you will achieve nothing less but pride in your accomplishment.

Question for you: will you be willing go through all navigating to learn and study trial and errors of others and then apply toward your pathway to get U.S. visa? Even this means making feedback or giving input from your candid observation.
