I'm in a relationship with a woman who is a citizen of Ireland. Here are the facts beyond that.

She works in finance

She is married and the divorce process is not yet begun but that is the intent

Neither parent is US born

Irish divorce law is ridiculous - the process from what i've seen takes 5 years making a fiancee visa unlikely for at least 5 years.

How up against it are we getting her here sooner than that so we can be together? Is there any hope at all?

Thanks in advance for your advice

Wow, 5 years IS ridiculous. Is there no way to speed up the process at all??? Your filing for any type of immigration visa for her will be dependent on her first securing a divorce. She can't be issued a K1 as your fiancé if she is not first free to marry when she enters the US.

Perhaps she can file for divorce elsewhere?

Sein oder Nichtsein, das ist heir die Frage.

You have to be separated for four years before you can get a divorce here as far as I know. If they have been apart she should be able to apply. My husband is a US citizen and he was able to get his divorce here in Ireland in a few months as they had not been together for years. There were no kids or property to split so that made it easier. Also he did it without a solicitor

She could pursue a work visa, if her company could transfer her to a US branch that would be best, but there will be no family-based option until her divorce is final. Good luck.

This may sound cliche but it is really your best bet: Go see an expert in Irish divorce law, i.e. an Irish matrimonial laywer. He or she will know better than any of us how to get the divorce done sooner instead of later.
