When we did our DNA test, I paid $750 for the whole thing plus $50 each for my daughter and Wife I am in the states, so they forced me to use the DNA Lab they have a "deal" with, which is the most expensive one. My daughter and wife did theirs at St Lukes. the whole thing took about two months. This was for my daughters US passport, CRBA and SSN. The results were sent to the embassy on the 19th of March, we are still waiting for her documents.

Did USCIS ask you to do a DNA? My daughter has a passport already. The court really didn't ask for the DNA when we had the hearing. The people who testified including my parents and midwife told the judge the truth. The USCIS denied our petition and didn't ask for any RFE but to appeal as our option.. They said that we are trying to get my sister (my daughter) and it's a fraud. That was their reason of denial.. It looks like to me that they didn't read the annotation of my daughters BC.

Thank you for sharing your experience.. I am willing to do DNA if it's necessary. I am going back to philippines to see my daughter in June 6. Will be there for 2 weeks. Do you think is it enough time? Is there any thing I need to do aside from that before the test? Is the test is going to be done in SLEC?

Much cheaper to do it there at St Lukes than out of country. You will need to try to get an appointment to take it while you're there before you go to be safe.

Now we submitted an appeal on January and we received a letter yesterday and yet they are still insisting that she is my sister, the petitioner's sister in law. We sent all the court docs and my daughter's BC with complete annotation with and a letter explaining about the whole BC thing and trying to convince them that we are praying for my daughter to be with us as a family here in US.

By the way when my husband petitioned me with fiancé visa. I declared that I have a daughter.

Appt. from saint Luke's? Do I need a request from USCIS for DNA too?

Our situation was a little different, but I'm pretty sure that they have to request the test. Once they do they schedule to test, but I'm sure once it has been requested then you can call the embassy and request a different day. Have you inquired about this to the USCIS?

Your daughter has a US passport?

DNA would prove blood relation but not degree of relationship (mother-daughter or siblings) hence it will be very unreliable evidence considering USCIS already thinks you are related to her.

Maybe you can send them the evidence you submitted to correct the BC

Good luck

Namour you took the words out of my mouth. It would be difficult for a standard DNA test to determine if the person is your sister or your daughter. The only other thing I can think of is to obtain all the court documents and recording of the court proceedings, have them translated, and submit them.

You have no proof of the pregnancy and birth other than the word of someone. Did you give birth in a hospital or at home? If it was at the hospital can you obtain those medical records. Maybe records of a pre-natal or post-natal visit.

I hate to say this but in a country where bribes and fraud are common the US isn't going to just take someone's word for it, they want some kind of solid proof.

This depends...

Collect DNA from the child.

Collect DNA from the Mother

Collect DNA from the child's Father

Collect DNA from the child's grandmother.

Collect DNA from the child's grandfather.

IF, IF! the child has a DNA marker that is only shared with the Father and NOT the Grandmother or the Grandfather, would prove that the child's Grandmother did not give birth to the child and thus the child could not be the petitioners sister. Unless the Grandmother is into really younger guys of course...

Just food for thought...

If the child is a son, just use mitochondrial DNA....

I do not know where is my daughter's dad. We dont have communication.the DNA is between me and my daughter. Apparently USCIS wants more evidence. They are not satisfied on the court documents we submitted and still thinks that we are trying to petition my daughter fraudulently because the BC was changed after 6 years or couple months before we filed her petition.

What proof do you have that it is much cheaper at SLEC then out of country. Will the USEM accept the DNA from SLEC? Does SLEC do DNA samples?

Your "advise" offers nothing for the OP.
