I don't think you understand the AOS process, DV2015 interviews start in Oct and yours may not be until the following spring. If your EAD is 2 months after that are you prepared to stay for almost a year with no work. Also at any point if the H4 fails you have no legal status which may mess up your plans

Even if the OP decides to do CP, the OP has to stop working in July anyways, so I really don;t understand what the question "are you prepared to stay for almost a year without work" is about.

And what's the basis for the H4 denial? If the spouse has already been approved for H1, the OP's H4 approval is a mere formality IMO!, unless the OP and his/her are unbale to demonstrate they're genuinely married whick I doubt is not the case.

Anyway in that case before deciding it's going to be difficult, he should rather find out first. For many countries it's easy enough doing it even if you don't reside there, sometimes online, sometimes via embassy, sometimes via agent. Less hassle than potentially losing your visa chances....plus the hassles with status and work situation.

Be doesn't seem to understand it, or maybe I don't, because he says he can get the EAD before the green card doing AOS, as though that's an advantage, but the way I understood it was that is unlikely to happen (does he even get an EAD in this circumstance? I mean that would be on basis of potential successful GC and we have heard of AOS people who have been denied?) and if he can get EAD this would happen the month after"current" month (from mom's previous answer to him) but if he did CP he would already have his immigrant visa in the "current" month which he can immediately convert into GC by going back to US. So CP means he has a green card before he would even have an EAD doing AOS?

The purpose of a GC based EAD card is to allow an applicant take up employment prior to their AOS applicantion being adjudicated. It really doesn't serve much purpose for a DV-based applicant because the GC itself typical gets approved about 1 - 2 months after. DV-based AOS applicants who get put on AP following their interview may also benefit from it as they can remain in the US and continue working pending the resolution of their AP process. It is ideally useful for applicants who may have to wait months or sometimes years before their adjustment application gets adjudicated and it is not based on an approved GC application.

3. EAD card is usually issued about 2 months after the EAD application is recieved. So if for instance the VB indicates in February that your CN will become current in April, and you send in your AOS package in March and it's accepted, then you're likely to recieve your EAD card around May.

Mom, quick question for you, have you ever encounter any AOS case when they have issued the EAD cart but the FO has not gone through with the interview, thus not adjudicating the case?

No, I haven't encountered such a case. But there are cases where applicants were issued with EAD cards while their AOS applications were pending and the AOS got denied eventually. The EAD card then became invalid upon the denial of the adjustment application.

Another forum has excellent resources on AOS, you will get all the help you need for free. Not sure about the etiquette of advertising other forums but this will be your best resource. Also has a spreadsheet explaining in detail the process.

Simon why is the old forum keeps on collapsing ?

I'm not really sure. I think the sheer size of the data is too much for the vBulletin software to handle. They have switched to better software now, so hopefully that will solve the problems - but I am trying to convince the owner to convert all the old data.

The old forum is up, so the data won't be lost, but I still hope the data will be migrated to the new forum. Some of those old threads are priceless. Where is Sloner btw? I miss his lunacy!
