Oh the Irony.

You were quick to ask me who I was to judge (when I didn't), yet you are questioning why I even posted in the first place.

The proper answer was given before you or I posted. I simply backed it up and provided a link for further reading. You and a few others like to jump in and shoot the OP down without having any idea what the actual facts of his case are. He may be eligible for a provisional waiver which could mean only being out of the US for a very short period of time. Or he may not be, which neither you or I know. But you were quite quick to jump in with the you broke the law suffer the consequences line without having a clue to his situation. There are plenty of people on these forums who thrive on being negative and rude instead of providing accurate, useful information.

Funny you didn't like my assessment of your participation but had no problem dishing it out to someone else. See how that works?

I don't know who you are and neither you me, as we are just sitting at the computer and firing meaningless responses. So I'll go ahead and end it right now. You are right. Sr, my hat goes off to you! I came to this website to find answers to my questions and I have been getting tremendous a lot of help ,for that I am grateful. But also I had come across to numerous posts that are extremely negative, judgmental and rude. I even posted a topic asking the moderators why do they allow this kind of BS? we come here for help, we all have different situations and we live on the edge as we go thru the process, no matter how easy or complicated our cases can be, this process it is extremely delicate and important to all of us. So we come here and ask a question, we expect answers that could help or not, but the last thing one needs is shitty attitude from a bunch of " mr. know it all " and forget about showing a minimum respect. The truth can be told in may ways, why choose to be a$$holes? . If there is a productive input one can offer, please go ahead but if all they have is an opinion, either they should keep it to themselves or try hard to not be bitter and negative.

Some of us also live in areas like southern California where we ae constantly confront by people that jumped the border then demand that they have the "right" to all sorts of things including priority immigration. My personal opinion is they should be barred from immigration rights for at least 10 years for the first offense and unwaiverable life time ban for the second offense. Being so over exposed to lawbreakers that suck the state resources dry at the expense of taxpayers and want to immigrate immediate because they broke the law makes being civil difficult at times when someone looks for help.

This will not be over quickly. You will not enjoy this.

The correct advice given in this thread was not a way to circumvent the law. The law allows for a waiver in many cases. It doesn't matter if I like it or not, it's just the way it is. People keep harping about the law being broken, yet the ones that made that law allow for a way for it to be overcome. So even though we don't agree with law, we should still provide the proper advice and point the person in the correct direction. Your personal opinion or mine doesn't change the law. If we want to change things, elect people who will take a stand and change it.

In this thread, we have no idea about the details of the case, yet the big focus was, how did he get here from his home country. That doesn't really matter at this point. He was given good information on where to start. His violations may be so severe that he cannot get a waiver, or maybe he is eligible for a provisional waiver and will only spend a week or two outside of the US and not one of here knows what his circumstances are.

The laws that afford all immigrants access to due process is the same that affords you the privilege of bringing your loved one to the US. My personal opinion is that we let the legal system and the immigration system take care of everyone, just like they took care of you.

You were given the correct procedure to follow. Have your spouse file the I-130. When it is approved she will file the I-601A (she will need help with this). When the waiver is approved you leave the US and go to the consulate you listed (you must be legally there and a resident there) most likely your home country. You will have your medical, gather all your documents, and have your interview THERE, in the country you are from.

There is currently NO WAY for you to obtain a green card without leaving the US.

I am assuming that all the negative, judgemental replies in this thread understand that it's not amnesty that is being discussed. What is being discussed is a provision in the immigration law that allows for waivers in certain cases. The person must follow a process to do this. This isn't about crossing the border and suddenly becoming legal. I would suggest voting for candidates who oppose this part of the law and promise to work with Congress to get it changed.

If the original poster has been truthful, the law allows him the opportunity to file a waiver. This site is about helping people and helping him is not violating the law or encouraging him to violate the law. It is about helping him to follow the law and let him attempt to get what the law allows.
