Being that your country says Ghana, I'm wondering how you were able to enter the US without inspection. I'm not being judgmental, I am just wondering

I was wondering this too. Flew to Mexico first maybe? ( It's no easier to get a Canadian visa than a US one so that land border I doubt was the means. ) Ship stowaway? Dangerous business that.

I am just curious about this: how did you come in all the way from Ghana without a visa? From Ghana you must have come by air. They do not let people board the aircraft bound for US without a visa, and in fact if you stopped over in Europe, they would also have checked your visa before you boarded your connecting flight.

I was wondering this myself as well. Doesn't really make much sense.

Used to be many Africans would travel to Asia and get fake ID and board there. It seems before 9-11 they didn't look too close at the ID used to enter the country. I know at quite a few that entered that way back in the day

This will not be over quickly. You will not enjoy this.

You mean... A bit like the fake passport /ID rings that seem so prevalent in Thailand that came to light after MH370?

This is the best (and correct) advice on this thread. Not all hope is lost for you. Good luck!

Your spouse should file an I-130 for you immediately (immediately because it's going to take around a year to be approved).

After the I-130 is approved and you have paid the immigrant visa fee with the NVC, you should then file an I-601A provisional waiver of inadmissibility. If this waiver is approved then you will depart the US and interview in your country of origin for an immigrant visa. Since your provisional waiver would already be approved then it should be a fairly simple route to approval.

You cannot file the I-130 and I-601A together.

You should consult with an experienced immigration attorney prior to filing the I-601A waiver, and consider retaining their services.

Find a way to illegally get out of the States (Mexico?) Fly back to Ghana, and hopefully you arent in the System.. Then start over.....

15 years and just finally trying to figure out your status?

Forget my advice earlier, Serve your ban and come back anew. That's the price paid for breaking the Law.

Were you under 16 when you came in? you could use that route... Lawyer up though either way you choose

The law allows for a waiver in many cases. Who are you to judge?

It's very easy to pontificate from ivory towers so high you can barely see them.

The world is rarely as black and white as many people would have you believe.

Judge? Do you even understand the word?

Read my post again and re-evaluate before you type.

Was the Law broken? Is there a price for breaking it?

No matter the option he chooses (which he may not have a choice), he will still need to go back to be able to Adjust his status

So all I did was state the inevitable. I didnt condemn.

The truth is bitter but that's why it is the truth. When you come in illegally, you should plan for when you do get caught because the consequences are dire. So go back home, fill out the waivers, get a good lawyer, prepare for the worst (serve the 10 years) and hope for the best.

I understand perfectly. Perhaps you shouldn't have responded to begin with since you added nothing to the topic?

Albeit possible, this course of action is far more draconian than warranted. The current law affords far less dramatic enterprises.

Oh the Irony.

You were quick to ask me who I was to judge (when I didn't), yet you are questioning why I even posted in the first place.

I apologize, I guess you own VJ as well as my computer. GTHOOHWTBS!
