Hello everyone. I studied on a J1 visa and I am curious about the J1 waiver.

I read about the waiver, the no-objection statement, and speaking to my consulate or a ministry.

The reason I want it is simply to free me from the 2 year home requirement to be with my fiancee.

Is it unlikely I can qualify for this since i don't have many motives (not returning to study, no job offers) since I only want it for my fiancee?

Also, is this waiver even within reach if I have already left the US?

Hi. I did this waiver for my J1 visa some years ago. Although, I forgot the process, it's really very easy. You basically have to explain why the waiver should be granted. In your case, because you want to live and plan your life with your future spouse and also adjust to living here in US. You will actually need to ask your home country to free you from the 2 year home residency. Once your home country issues you a no objection letter, then you shouldn't have any problem with the US to approve it. You should also include in your letter that your home country did not pay for anything for your travel or stay in the US and all your expenses were paid by you personally during your J1 stint.

I was funded entirely by the US however (which is why I am subject to the rule) like I assume you were

So if I create the letter, should I just clarify that instead of me paying, it was them (the US)?

What did you do during your J1? Please read the waiver form regarding the conditions/qualifications for waiver.

Participated in a government exchange program (UGRAD), went to the US for a semester, received stipends from the US monthly to pay for me. Left December of 2012 and it expires this year of December. Some websites say I am cannot get it because the US paid for me while others say I still am eligible.

You can always apply, but it is unlikely that the US will grant a wavier -- they financed your program so you could take your new knowledge/skills back to your home country. The good news is that you're in the last few months of the two year requirement, if I read your post correctly -- and it probably isn't that much difference between the time it would take to process the waiver and when your two years would be up anyway.
