J1 Au Pair Visa .. Again!

A friend was an au pair a few years ago. She was an au pair for two years (she extended back then). She then went to her come country and stayed there for two years. Can she again apply for a j-1 au pair visa??

AOS from F-1 Timeline

(based on marriage to USC)

2010-06-12 Send I-130 and I-485 packages

2010-06-16 arrived at Chicago lockbox

2010-06-23 Checks cashed

2010-06-25 Received NOAs for 1-130, I-485, I-765 (EAD) and I-131 (AP)

2010-07-09 I-130, I-765 and I-131 touched

2010-07-23 called USCIC about biometrics letter. They said to wait another 45 days

2010-08-10 infopass appointment to expedite I-131 (AP)

2010-08-13 I-131 (AP) touched and approved

2010-08-13 I-765 (EAD) touched

2010-08-19 I-131 (AP) touched

2010-08-21 I-131 (AP) received ...YAY!!!

2010-08-27 Received my biometrics letter

2010-09-07 Biometrics done, touch on I-765 and I-485

2010-09-07 I-765 (EAD) approved

2010-09-17 EAD and interview letter received

2010-10-22 Interview --> Approved

2010-11-04 Received GC in mail

ask her to send you a scan of the j-1 visa stamp from inside the passport,

then you study it

looking for 2Y HRR wording in the stamp itself.

Report back, when able, as the existence of this annotation is the bit that makes the difference.

She has already been home for over two years. I am unsure about whether she can have the au pair visa twice even though she already extended the first time she had it.

I don't know what her scan says... But I am not worried about the two year home requirement as she has been home for two years and would be fine with that. What I am wondering is if you c an get the au pair j-1 visa twice if you have already extended on your first time around. Does that make sense ?.

Is she still a student? Prerequisite for J1 is to be a student under the age of 26. If she fits the category and her local au pair agency has a family for her I don't see why she couldn't get another au pair visa.

Yes she can. I was an au pair twice. I waited two years in between. As long she is no older than 26 she will be fine.

J-1 Au Pair Visa :

09/29/2012 : Met with USC
01/14/2013 : Married with USC

AOS Timeline :

06/09/2016 : AOS package sent

07/04/2016 : AOS package received (finally I was dying over here)

07/08/2016 : AOS package accepted !

07/28/2016 : NOA1 for I-130 was returned to the USCIS. The post office did not deliver it to me !

08/07/2016 : Card/Document Production ( no NOAS, no biometrics...nothing ??? )

03/26/2018 : Green card received!

02/12/2021: Filed for N-400  online
