Consent Letter (PERU)

Hello, i'm not exactly sure where to post this, but here it goes.

My dad has married a woman in Peru, lets call her Linda, and he is in the process of bringing Linda and her son Roberto here from Peru. My dad had paid for Roberto's father to sign a letter of consent allowing his son to leave the country with his mother Linda. (the father had to be found because he is not in the child's life.) He signed the paper about 2-3 years ago.

Okay, so now my fathers wife Linda and her son Roberto finally got their visas a few months ago. About 3 weeks ago they were at the airport about to leave for the US, when apparently the Peruvian embassy would not allow Roberto to leave the country. Linda had told my father that they said that the notarized paper his father had signed was only temporary and had expired.

So my question is, Why did the U.S. give Roberto his Visa in the first place without this important piece of documentation that will allow him to leave with his fathers consent?

There was so much information that was needed to be sent for them both to obtain their visas, it was a long process.. but how could they not want this obvious important piece of information?

My family has believed there is something very suspicious going on here, but we just don't know enough to verify it.

If someone could please help i would greatly appreciate it, Thank you.

There are no Peruvian embassy in Peru. Do you mean the US Embassy in Peru?

There is no US Embassy control at the airport. The airport is controlled by the Peruvian government.

Who exactly did not allow the son to board the plane?

I suspect it was the Peruvian government. They will enforce their own laws regardless of the fact that the US Embassy issued an immigration visa.

Hello sos321,

I'm sorry this is happening to your family. However, that is not a US issue, it is an issue with the Peruvian government. NVC and the embassy found the old letter to be sufficient but the Peruvian immigration probably requires a more recent notarized letter. I remember when I was a minor, my parents had to get a new notarized consent form for every time I flew out of Peru (traveling with only one parent).

04/01/14 - IV shows "PAID", DS-260 available
04/05/14 - DS-260 complete and submitted
04/07/14 - Civil docs arrived via DHL from my wife. IV packets sent (Finally!!)
04/14/14 - False checklist for IV packet (wife and daughter)
04/15/14 - Confirmed AOS approved (did not ask for specific approval date) - IV packets in system

04/25/14 - CASE COMPLETE (wife and daughter) :dance:

04/30/14 - Interview scheduled (yay!!)

05/02/14 - Received e-mail with P4 letters

05/07/14 - NVC shipped case files to Lima Embassy via DHL. CEAC status "In transit"

05/09/14 - DHL delivered case files to Embassy. CEAC status "Ready"

06/09/14 - Medical Exam. 4pm appointment

Your question is really only a complaint, and the answer won't help you. What is needed is a notarized letter giving permission for the child to immigrate to the USA with his mother to reside permanently in the USA. I don't know what the original letter said but if it only gave permission for "travel" and not immigration and permanent residence abroad, then it would be considered "temporary".

You need a solution, not a "why did the give...?" answer. The solution is a new letter giving the proper immigration and permanent residence abroad permission ASAP, before the visas expire. They are valid for six months.

Facts are cheap...knowing how to use them is precious...

I can't help you with the facts. No one here can help you determine if your facts are correct. To me, it seems like you got your facts wrong because the US Embassy has zero control at a Peruvian airport.

Good facts gets good answers. Inaccurate facts gets questions.

The US Embassy followed US laws in issuing the visa. Those laws are not always consistent with local laws.

Under US laws, the son can immigrate to the US and the consent is valid.

Under Peruvian laws, the consent is too old and invalid.

The problem is not on the US side. The problem is on the Peruvian side.

The US has zero control over a child leaving Peru. The US is only concern about who enters the US.

Peru has 100% control over a child permanently leaving Peru.
