I tried to get help with this before but have yet to find answer on this. On our registration of marriage my name was misspelled by 1 letter. Malissa instead of Melissa. My husband called the court in Delhi to see how to fix this and they told him it would be a month and I cant fly back to India in a month to sign the registration of marriage again. I fear this will cause a RFE when I file for the petition to bring my husband over. Has anybody had this problem before and how did you handle it. I thinking a written letter by me explaining the situation and getting it notarized might be a good idea. If anybody else has any ideas on what we need to do, it would be greatly appreciated. :rolleyes::rolleyes::rolleyes:

Do whatever you have to do to get the marriage certificate corrected. What that will be, is up to the court. I don't see a reliable way around it. I take it you signed this document with your name misspelled. Is that correct?

Do whatever you have to do to get the marriage certificate corrected. What that will be, is up to the court. I don't see a reliable way around it. I take it you signed this document with your name misspelled. Is that correct?

Yes, both my husband and I are surprised that we did not catch this. I am thinking of sending both the registered marriage and the Hindu marriage also which has my picture on it to prove its me till I can afford to return to India to fix.

You shouldn't have to go to india to get this fixed. we used an agent from Your Man in India and he fixed hubby's birth certificate (which had a completely wrong name) it costs a little more (around $100) but they did all the legwork at the municipal office and got us 4 certified corrected copies to submit. oh and it was done relatively quickly (under a month)

That's great!!!! I will let the husband know about this so, we can start working on fixing this problem. Do you think I should wait to file after we get the marriage certificate fixed? I really wanted to get the ball rolling on the petition since I know its going to take some time.

I don't know how much of a problem it will create if you send the packet with 1 marriage certificate (that is spelled wrong) and then update the packet later once its fixed? Or do you send the packet without the marriage certificate knowing that you will send it as soon as you get it corrected? Maybe call and speak to tier 2 and see what they recommend?

also see how long it will take to get the marriage certificate fixed, if its less than a month i would wait and send everything together and correctly the first time, since sending incorrect MC or not sending the MC at all might delay processing by more than a month anyways so it would have been worth it to wait for the corrected MC and send it all together!

This might help, as the local officer may be willing to verify that the Malissa on the marriage certificate is the Mellisa standing before them. Be prepared with any possible evidence that will establish that fact.

Ok I talked to a tier 2 and he advised me to make an info pass appointment to look at the marriage certificate and to see if it will cause a problem.

if your marriage certificate is like ours you should be fine. Ours has out passport photos on the MC along with our full names, DOB and signatures i would guess that if yours is like that too then at the infopass appt it should be verified that its not a problem at all!

hoping for the best for you!

Now my marriage certificate of registration of Hindu marriage act does not have our picture on it, but it does have my date of birth, address and my signature on it. My Hindu marriage license has my picture on it. I guessing I should bring both documents in.
