Visa options for Master of Science in Computer Science and Engineering

Hi,

I am sure you get this kind of thread often, I have been looking around and did not find any that can be applied to me, so I took the change and create a new topic.

As part of my Masters did I spend 1.5 years in San Diego where I well in love with Southern California. In about 2 months will I finish my education and are looking to move back.

I have been talking with computer science talent agency in Los Angeles, to help me find a job, but sadly do they now know much about immigration, I am therefore doing some research in how I can get a work permit.

Now as a 28 old single male, with a Master of Science in Computer Science and Engineering, an impressive resume, and I have had an F-1, what are my options?

So far have my research found that there are two different process, either get a job offer first or a visa first. As I understand it is getting a visa first, requires me to have extraordinary abilities in the sciences, but dose my education and resume alone satisfy this requirement?

Getting the job offer first, may be the best way to go, but less employers are willing to go through the trouble when I don’t have a visa already. Will applying for the extraordinary abilities visa disable me from later or during the application process to get a visa via a job offer?

Your education and resume has little chance of satisfying the extraordinary ability requirement. Need to find employer - if you're good, it really should be that much of a problem.

Your only problem may be that only applicable visa in this case is H-1B and earliest you can get one (unless your employer is quota exempt) at this point is October 2015.

You mean O1, you can google the requirements and see whether it is worth seeking professional help in applying.

Sort of surprised that a US IT Recruiter is not familiar with Immigration options.

You were here for some time, networking is probably the best bet to get a job offer.

If the route is H1b yes.

Lots of routes, whether any are suitable I do not know, which is why the Employer has a Lawyer.

Lots of routes, whether any are suitable I do not know, which is why the Employer has a Lawyer.

Hehe yes, the problems is that i have to sell it a bit to them first, so i basicly have to do the job for the recruiter. But any points in what other routes may be of intrest for me would be great!

Wait for a H1

Personally I would go for getting a job where are you who would transfer you after a year on a L.

I see you are single, that gives you options as well.

Are there any other routes then? as i do have a company that is willing to hire me, but will not wait for May 2015.

Talk with the DSO at your school about OPT - nowish.

From the original post, I don't think the OP is currently in the US on an F1 visa -- so OPT is likely not an option.

positional modifiers were out of whack - made it difficult to ascertain sidereal motion and past/current/future tense - so I read it 14 times - and extracted this nugget:

and I have had an F-1, what are my options?

so - I am positing he's still here on the F-1 and not completed his Masters' Degree YET - but he's right at the edge.

Talking with a DSO at his school is his best bet to get enrolled/engaged in OPT ...

Then apparently there's a firm that might put him to work - OPT gives him a year and an EAD and a SSN.

I read it that he is finishing his education and wants to move back to the US.

OK - that might make sense to me if he was on a foreign-exchange program with a university - where is foreign university and the usa university have an agreement on stuff -

first semester in foreign country -

1.5 years in USA going to school on an F1 visa-

final semester back in the foreign country.

as to his options for OPT - is more doubtful - but if it is the USA university granting the degree - then maybe it's possible. maybe... and worth further investigation ...

Language is SUCH a fun thing to play with. You keyed in on exactly the phrases that led me to the opposite conclusion! Ah, the joys of communication.

I read the "...and are looking to move back" as meaning I'm finishing in my country and want to move back to the US (otherwise, why would the OP be asking about how to go about doing it?).

And the "..have had" an F-1 means I have had one before (....but I don't now).

I can see either reading as being correct -- so, hopefully, the OP can figure out which answers match his true situation -- or come back and explain more!
