Social Security Card Problem

Timeline

My fiance arrived on a K-1 visa in October 2006. We applied for a social security card in her maiden name and received it. Then, we married in December 2006. Her I-94 expired in early January. We just went to the social security office to change her last name. The office told us that she can't change her name, because her I-94 is expired. They said that we must wait until she has a green card from immigration or get a new I-94.

How can we get a new social security card with the last name change? Do we have to wait for the green card?

02-21-2006 Mailed K-1 application to Nebraska.

02-23-2006 USPS online confirmation of delivery.

02-24-2006 NOA1 (received 03-02-2006).

02-28-2006 Touched - first time.

03-01-2006 Check cashed.

05-03-2006 NOA2 - 68 days from NOA1.

05-16-2006 NVC received application.

06-27-2006 NOA2 again?

08-08-2006 Interview at Kiev embassy.

08-09-2006 Received the K-1 visa.

10-07-2006 Arrived at JFK airport.

10-26-2006 Applied for Social Security card.

12-29-2006 Married!!!

01-03-2007 Received Social Security card.

01-22-2007 Mailed I-485, I 765, and I-131 forms.

01-26-2007 NOA for I-485, I-765, and I-131.

01-27-2007 Received Illinois state ID card and driver's permit.

02-15-2007 Biometrics appointment.

02-28-2007 Received driver's license.

03-08-2007 I-485 approved.

03-15-2007 Received Permanent Resident Card.

03-15-2007 Applied for Social Security Card with married last name.

I just expirianced the same thing yesterday at the Social Security Office, except in out case the Visa does not expire until the 14th of Jan, but the lady said that since it was within 2 weeks of expiration that they can not make the name change and we would have to ask for a new I-94 or wait for the Green Card.

Has any one else had this experience, and if so, what is the quickest way to get her name changed now??

6/9/06 Received 2nd letter from NSC telling me that my case as been transefered

7/3/06 Received RFE today in mail along with 2 emails

7/6/06 RFE received in California

7/13/06 Received email saying RFE had been received

7/31/06 Received (3) emails saying my application has been approved

8/1/06 Touched (hopefully that means that my application has been mailed to NVC

8/15/06 NVC mailed application to Bogota

8/25/06 Luisa received Packet 3 from Embasssy!

8/28/06 Luisa hand delivers Packet 3 to Embassy!

9/6/06 Luisa receieved Packet 4 from Embassy

9/18/06 Medical Exams

10/3/06 Interview Date!!!

10/4/06 Have Visa in Hand!!

10/16/06 Return to EEUU

01/06/07 Married..... Now trying to complete the EOS stuff!!!

07/02/07 Green Card Interview, we were approved!! Now we wait for the actual card!!

07/18/07 Recieved Green Card in the mail!! Yippeee!!!

Same here ...they have told me that i cannot change my name on mine until i get my status changed because my I-94 has run out

I was a shade above 15 days before mine expires and I got my name changed today. So My guess would be to change your liceanse if you can, I guess you can always show your marriage certificate too. But waiting for the GC seems like the concensus.

K1 Journey:

April 13/06 NOA1 from NSC

June 1/06 - Moved to CSC

August 12/06 APPROVED - NOA2!!

August 28/06 Left NVC. . . Vancouver Bound!

September 27/06 Interview APPROVED, with visa in hand

October 29/06 Moving Date

December 30/06 Married!!

January 16/07 Sent out AOS, EAD, and AP docs

January 23/07 NOA1's for AOS, EAD and AP

February 13/07 Biometrics in Portland, OR

April 7/07 EAD and AP Received

This happens frequently. To get a new SS card with the new name the woman will need either an EAC or a Green Card in the married name. Right now, the USCIS SAVE data base still shows the maiden name.

Don't fret about it - it's having the SS card that's important and your wives have the card. The maiden name on the card is not important.

I'm in the same situation, and yes - I am waiting for the green card! :)

We went through the same thing. We were told we woule be able to change it when we received something offical from the USCIS with her married name which was the EAD. It took about six weeks after that to actually get the new card. Good luck

I used my EAd to change my name. They had to verify everything with DHS so it took 6 weeks for the card to arrive.

Yep you'll need that EAD or greencard to get the name changed.

Yep Same here. I was told once i rec'd EAD i would be able to change my maiden name on SSN to marriage name... the guy where i got my photos for FBI told this also. However i also pushed the issue here in Tampa as i want to move on as "normal life" but still strugglining like we all. Anyhow i have been assured once EAD is issued there should be no problem! what a bloody hassle this is???? man, i gave up a super life in oz to deal with this wonderful red tape for love...... well, its worth it in the end!!!! maybe they should give class or this forum when we step in the bloody couuntry!

24th of June 09- Walked in for Biometrics.. they took me :-)

16th of July 09- received my congratulations letter!!!

21st of July 09- Had my 10 GC in my hands!!!

Same situation here but I appllied for a State ID for my picture ID. I presented my SS card, my passport, my drivers license that I got from my country with my single name on it. I also presented our Marriage Certificate.
