hey again guys. this has bothered me all day and made me very anxious. :c a few things we need help with:

1. so my co sponsor is still perfectly willing to sponsor me, but while the 2012 tax returns (which i took to my K1 interview) were more than acceptable by the London embassy, 2013's returns show a loss on line 22 which would put us below the 125%. is there anyway we can prove income to USCIS other than this tax return? they have helped us out a great deal since i arrived and are more than capable of helping us if we need it, how else can we prove this? (they are self employed so i know this is harder to prove :/)

2. additionally, my co sponsor has assets, (am i correct in saying automobiles count if there is more than one working automobile? i recall reading this somewhere..) can this help us much and how do we have to prove it?

3. my fiancé, however, now makes above the 125%, but the problem here is that his tax return only shows a small portion of from when he started work last year til tax time, so it doesn't show what his proper annual income would be. he also did not file taxes in 2012 as he was not earning any income and was in college (however he received financial aid at the time, does this affect us any?) and did not file taxes in 2011 as he did not earn enough. is this going to be a problem?

4. i know that regardless we have to do an I-864 for him, but is there any way we can prove that he does make above the 125% aside from tax returns? his recent raise pushed him above the requirments, but he doesn't have a paystub which shows the raise yet. he works from home but is employed by a company so most correspondence with his boss and colleagues is done via emails etc. would USCIS accept something from his boss explaining the recent raise, his hourly pay plus the fact he earns commission, etc? how else can we do this?

5. also, regarding my fiancé's I-864, is it possible, if we can prove he is over the requirement, that we could be accepted on his income alone? even though we only would have the one tax return? in this case, do we still need to send the co sponsors I-864 just in case, or will USCIS RFE us and request it and then we send it?

If he makes enough, then don't even try using a joint sponsor that does not.

Yes, prove his current income with a letter from his employer, if he has no pay stubs.

Only the most recent year's tax transcript is required to be provided with the I-864. Not having filed the other 2 years does not mean that you cannot sponsor on your own. Just need to provide the required statement explaining why he was not legally required to file those years. Current income is most important, not the past.

If they do not believe his income meets the requirement, they will send an RFE asking you to prove the income and/or provide proof of assets that will help you reach the requirement, or to provide a joint sponsor. If it comes down to needing a joint sponsor, you need to find one that actually meets the requirement though.

So you think just send my fiancé's I-864 and just wait and see what they say? We can give a bunch of paystubs that can prove a previous pay raise and by the time we plan to send our AOS, I am sure he will have received at least one paystub showing the new income. In fact we worked out that even before the raise we were above 125% which is awesome

One thing about my fiancé's job though, is he works from home and the company is a few states away from us. Do you think that USCIS would accept an email or fax from his boss, or do you think it would need to be an actual letter mailed to us?

Yes, since he does meet the income requirement, I would suggest trying to send the I-864 on his own without a joint sponsor first.

If he can provide recent pay stubs, then I think a faxed letter with the employer's signature on it should be ok to go along with the pay stubs.
