Wanting to move from Canada to the US

I'm a dual US/Cdn citizen living in Canada with my husband and children who are Canadian. We would like to move to the USA but are confused on the process. I'd like to have my husbands PR status before we move there, is this even possible?

We cannot find a work type visa that he would qualify for.

We cannot go the K3 route as our marriage took place in Mexico and this complicates the filing. If we file the I 130 from Canada are they free to move with me to the USA once it's approved, then we complete the process there?

Has anyone been in this situation? Thanks for the advice!

You can file for a spousal visa. He would get an immigrant visa and once he enters the US on that visa, he becomes a US permanent Resident.

Follow the IR/CR-1 spousal visa guide in the guides section. it starts with a I-130.

2/06/13: APPROVED!

Forget the K3, more expensive and for practical purposes, dead.

IR1 way to go.

Have you lived in the US for at least 5 years with two of this years after age 14? If yes, then your children are dual cituzens. If no, then you need to petition for them.

There is no way to get LPR status before moving to the US. Your family can get immigration visas which upon entering the US gets them LPR status.

They cannot move to the US without immigration visas. There is no moving before the process is complete. Approved I-130s do not give them any rights to move to the US.
