Sometimes stupid things that we do as adults come back and bite us in the rear end later on in life, this is one of those times. These immigration laws are there for a reason, to keep certain people that are not desired out. 2 drugs arrests, a drunk disorderly, and a mystery one, I would say that's an undesirable. We already have plenty of them all over the country, we don't need any more.

If you are not willing to make the sacrifice and move since her can't come to the US, what does that say about your relationship, or more so about you? Something to think about I think.

Regarding the suggestion about prayer is all that she needs... are the people that write that living in a fantasy world? :wow:

love is more important then money or anything, id be poor to be with my fiancee and if we had children, i would just leave so parents are together wherever to be a family, sad story, take your child and go be with him, be happy and deal with things

I really didn't think that I was going to have to disclose everything on here but I really can't move to the uk because my husband is having a really difficult time mentally with our situation that he is having to resign from his job this month and I can't live in uk with me not being able to work plus my husband not having a job...can't do it!!

Him coming to the US isn't likely, unless some serious waiver magic is worked.

If he quits his job, you can forget about being able to go to the UK to be with him any time soon, too.

Now's the time to buck up and figure it out.

...We quickly filed for a K1 fiance visa...either an E visa (investor visa), H1 visa (working visa) or some other one which I forgot...

Did I miss something? Did you ever file for a CR-1/IR-1 visa? Maybe someone knows if you have better chances if you are already married and are going with an I-130???

It's amazing how many questions can be resolved with a 2 minute Google search...

Well, we are still living in the dark ages here in the USA with our draconian drug laws. Unfortunately, so is most of the other so called civilized countries on earth.

I know what I would do in your situation. I mean you could try contacting the couple of lawyers suggested here and try again for a waiver. But I'm just saying, if it was me, I would be immediately trying to immigrate to the UK. Maybe it's not the preferred solution, but family is more important than anything else. It's a tough choice, but I am 100% sure if my wife was not able to come here, I would try moving to her country, without a 2nd thought. And UK probably would be one of the easier countries to make a transition to. At least everyone there speaks English, so there's that.

Both are dealt with the same as far as waivers are concerned, in this case there is not one.

I will add to the first person that said pray....Pray pray pray pray pray like you have never prayed before. To tell someone that prayer will not do anything! Really? That is our only foundation. God is still in control of this world although it does not seem so at time. Op I can give you stories of how God has moved upon leaders of this country. If God want to in your case please take it to him. You and your husband is being tested, stay faithful and keep searching God will show you the way. Keep up posted on the outcome and don't give up. I will add...read some promises in Psalms just to strengthen you. God is the same yesterday, today, and forever. When you meditate on what he did for the people back then be encouraged that he will do the same for you. But...you must believe that {faith}.

Hi everyone I have been at work all day today (12 hour shift) just got home and have spent the last hour reading all the comments. And I appreciate everyone's comments and I am going to try and sort things out because to be honest I am still confused because it seems like the majority of you say that he cannot yet a waiver whcih is what I was told as well.

There are many reasons why I don't want to live in UK. I would prefer not to go into so much detail but it's mainly because of my daughter. I do NOT trust the health care system there at all. I think their health care is horrible and when I went there to celebrate my daughter's first birthday with her dad she got sick and got even worse after going through this stupid slow NHS system. I had to rush back with her to usa to get proper treatment. I am an ICU nurse and I have no tolerance for such horrendous care.

There are many more reasons why I cannot live in uk, my husbands family are all over the world, no one in the UK to watch our child. I will NOT hire some random babysitter. At least here on usa I have my parents, cousins and friends that watch my child.

Also my husband's mental state is not the greatest right now. He seems to always be in between jobs. I don't live there so I don't know 100% but it just seems like he's in the wrong field and always having a hard time with jobs. I don't blame him, we have been with this immigration drama for 2.5 years and it has been such a horrific roller coaster ride. He missed every memorable moment in our child life!!! How do you move on from that??

I need to make sure our daughter has one parent with a stable job and not having to stress over money.

Many many more reasons why it's best for my child and myself to stay in usa BUT she at the same time she unfortunately has to grow up without a father.

What boggles my mind is let's say worst case scenario my husband and I divorce. ..would immigration people even let him visit???

I don't know what to do anymore. The stress of me having to raise my child on my own from birth has also created so much anger, frustrations, stress and resentment towards my husband. I just don't know what to do anymore.

Your reasons for not moving to the UK are clear. It's your choice and understandable, but as many pointed out, looks like your only option, if you want to be with your husband and let him be part of your daughters life.

To your other question: No. He was denied a visa once based on those grounds. It will always be in his (immigration/counselor) file. He might get lucky one of these days, and a CO might grant him a B2 visa, but I wouldn't count on it. They will simply point out, that you can visit/move to him, too.

He is also not eligable to travel under the VWP anymore since a visa was once denied. You could try ESTA online and spend about $15, to see if its granted, but it's still no gurantee if he'll be let in if he jumps on the next plane.

I still hope personally, there is a way for you. And I think too, that living in the UK isn't the worst place to be (only Germany probaly would be nicer ;)

You are certainly entitled to your opinion.

In my mind, having seen both sides, healthcare in the UK is, for the most part, vastly superior to that in the US, both in access and outcomes.

And I told her pray.

But people here thought that I said that the only thing that she can does is pray.

I didnt say that is the onky thing she can do.

As I didnt have advise , I said pray.

Well , you have your rezons to no move to uk.

Only you know why. You know what is better for you and your daughter.

Love,can broke all rocks in the road.

When you love a person over all , you dont think in money first.

Love is more important that money.

I dont belive in the love that has conditions.

Sorry but when you love, the more important thing is be with the person that you love.

It doesnt matter if you go to end of the world to be with the love of your life.

If you're worried about the NHS, all you really have to do is make sure to live in an area where there is a good trust (i.e. a good zip code area) because the quality of care does differ, but there are many areas of the UK where it is excellent. Beyond that as well, if you really don't want to deal with the NHS, it is an option to buy private insurance in the UK, which is better than the NHS. You also have the option once a permanent resident of the UK with your husband to go abroad in the EU to become residents of other countries that have better health care as well. Your husband could also watch your daughter while you work and vice-versa...

Immigration doesn't really care if you and your husband divorce. The marijuana issue needs to be dealt with and he is ineligible for the VWP. If he was going for a B2, he would have to deal with the marijuana charge as well as the fact that even if you're divorced, his daughter is still there. Immigration looks for reasons to deny you, not the other way around.

The problem with trying to get a waiver (I don't know all the ins and outs of waivers for drug convictions) is that you need to prove why you cannot live in the other country with your husband. It's very difficult, especially considering how wealthy the UK is. There were a few people who got waivers a few years back (JustJ comes to mind; you could PM her), but in her case, she was the only relative that could care for her elderly mother who had many health problems.

Now post 45 on this thread and many comments seem to have only read part of one of them.

Forget the Immigrant option, he has 2 drug convictions. No waiver.

Forget the VWP, he has a criminal history.

He has tried on multiple occasions to get a B and has been refused, will that change anytime, maybe, but not likely anytime soon.

He could apply for another non immigrant category, H1b has been mentioned, but judging from the comments about both his work history and mental state that seems unlikely.

Non Immigrant waivers could waive his criminal past, they are more embracing.

OP sounds like she would not move State never mind country.

So game over.
