Refile I-129F ???

Timeline

Okay I just talked to my attorney and he advised me to Re apply the I-129F. I told him that my fiance was denied the visa because, he did not met the requirement set forth in 9FAM 41.81 N6.4 for k1 visa. He told me that I don't have to wait for the NOID letter, because I'm in the same situation like I was before when I didn't apply for the I-129F visa process. He told me to go meet my fiance and re apply. Also, this will not affect my I-129F process again. What are your thoughts on this ?

If you haven't met your fiance in person in the prior 2 years, your petition will be denied. If you were already denied once, and now you have met, you can refile.

That would be no problem... my fiance re-filed for like 3 times... but we dont have problem with the meeting stuff.. but we didn't have any problem on the third time.. we even had a quick approval from Vermont Service Center.

February 14, 2011 Approved petition from the USCIS (Vermont)
March 02, 2011 Received letter from NVC
March 05, 2011 Payment cleared
March 06, 2011 sent the DS3032 via email to NVC
March 09, 2011 received confirmation regarding the Choice of Agent
March 10, 2011 received the IV Fee invoice via email
March 16. 2011 sent check via USPS
March 18, 2011 received e-mail regarding the IV Fee payment and the package for AOS

Wow 3 times??? that's alot. And where my fiance will be interviewed, it's a very strick country. I hope this times goes okay. i'll talk to the attorney beriefly one more time and clear out some things before re applying.

Do what the attorney told you to do. You need to have met your fiance in person in order for your petition to be approved - go meet him in person then, when you've met the requirement, file a petition.

Okay I'll go meet him this summer and reapply I guess. I hope it turns out good this time.
