Hi All!

Does anyone know if an assault OB harm charge actually falls under moral turpitude?

My fiance was recently denied his K-1 visa due to an assault charge. It was a very minor incident where there was an argument between neighbors and he threw a rock and it hit someone. The person went to the police station and filed a report. At the court date my fiance pled guilty and was given one year probation which he completed with no issue.

The crazy thing is that this charge doesn't even show up on his police record...his police record is totally clean!

He was told his visa was denied because of a crime involving moral turpitude and that we need to file a waiver form I-601.

Does anyone know any info on how to get this waiver approved? It looks as tho I need to prove an extreme hardship on me the US citizen to get it approved.

Any info would be greatly appreciated!

Although 601 waivers have successfully been done by some, it is generally not a DIY kind of thing... There is another website immigrate2us.net that has a lot of detailed info on waivers...

How did they know that he had a problem in the past with his neighbor?

They found out out by background check, how was his record clean.USCIS

classifies those as Mpral turpide because violence was involved.

So I guess he was issued 221G (U have a yr to apply for waiver) best to

hire a waiver atty (CIMT) they will charge from $5000-$15000. depending

on who U get, how good they are, they don't have to be an atty from your

state , some have payment plans..Now start getting all paper-work on that

case, U the USC will have to write a letter of hardship...Y he has to come live

with U & Y cant U move to live with him. You can talk about unemployment

there, U not being able to work there, low wages, crime stats etc. The hardship

can only be on U the USC they don't care about him....Do it soon waivers R

now taking 7-12 mths. Best wishes

mention if U have school loans, financial hardships

and U wanting to have kids....He shoul pay & take some

anger management classes to show some rehab attempt

an some volunteer work with Liberty Hall (teaching kids to read)

hey i'm sorry that this happened. I also had to file a waiver and it was recently approved. go to immigrat2US.net and you'll get all the help there for preparing your waiver.

His police record is clean. They found out from his DS-230 form where it asks if you have ever been convicted of any crime and he admitted it on there because he didnt think it was a big deal. He only served a year probation for it and that was the only time he has ever been in any trouble. We were asked to file a I-601 Waiver. We are trying to research info on proving a hardship now. But it doesnt seem very prominsing.

Ouch! yea yea he had to be truthful there, getting probation even if its expunged CO

can deny and ask for a waiver, yes U have hardships everyone does, its how its put on

paper. I already gave U a few leads in regards to some hardships, it will fly faster for a

husband but not totally impossible for a fiancée, half the hurdle is getting that paper approving

him to for I 601 call Liz Cannon for a phone consult, U must speak to an atty, and its a matter

of getting docs together & evidences on case, also on his part showing some rehab for anger
