Hello,

I just created my account here and wanted to introduce myself and my case :)

Me (22) and my hubby (27, USC) met online in 2008, I visited 2 times in 2010 and in 2011 again. I was just visiting, didn't plan to stay or anything. I came to atlanta (he Is from alabama) on 5/26/2011 and He asked me to marry him on 6/6/2011 .. we just decided to go to the courthouse and got married 6/7/2011 :) we didnt have a big wedding. It was only him and me but I loved it :) well my hubby has a lot of health issues.. he was on dialysis and waiting for a kidney transplant since he was 16 years old. Long story short.. we just sent off aos and it was received 4/30/2014. Almost 3 years after we got married. I have read here that overstay is ok? Does anybody has experience or advice for such a long overstay? Also my passport just expired in april. Do I need to get it renewed asap or can I wait since it would be a long trip to Atlanta? It would be nice to have some advice!

I think overstay is forgiven, you do need your passport and above all proof of entry legally to the country Good luck in your journey

Yes overstay if you're the spouse of a US citizen is forgiven. There have people that have adjusted status that were out of status for longer than 3 years. They may be curious as to how you two have supported yourselves for the past 3 years, being that you didn't have work authorization and taking into your consideration your husband's health conditions. Might be something that could be asked during the interview portion but other than that your case should be processed the same as anyone else's.

You will definitely need to renew your passport as soon as possible, it is a crucial piece of identification during the process.

With that being said, did you apply for I-485, I-130 and I-765? Because if you also applied for I-131 Advanced Parole, since you've been out of status so long, if you were to leave the US even with that, the USCIS would considered you abandoning your application and can deny you re-entry. So best to stay put until you have that GC in hand.

Thank you! :) I applied for I-765 and I-131, I hope to start working soon. I don't actually need I-131 because we are not planning to travel. Maybe in December, maybe. I read everywhere it's best to file everything (I-485, I-130, I-765, I-131, I-864) so I just went ahead and filed it.. I hope the process won't take too long since I'm ready to go to college and start working :)

I just checked my case status on uscis and it only says application for I-765 employment and initial review. . Is that normal? Since I sent off all the other forms too?

For each form that you filed you will get an individual case number. So you'd look up each case number to see it's status.

You will need to get your passport renewed as they may want to see it when you have your GC interview. Do you have any other form of ID?

Congrats!! :) I'm so nervous and excited about everything lol :)

I don't really have any other ID since I came on a tourist visa I can't get a drivers license.. I read on here somebody used their birth certificate and marriage certificate at the biometrics appt. I think it would be best to get my passport renewed though. Just hate to go to Atlanta so often, I hate big cities and traffic... lol but I can't get around it.
