Hello, I am preparing to organize tax transcripts of 2011, 2012 and 2013 for NVC while I am waiting for I-130 approval. The martial status on my recent tax transcript (2013), that I downloaded from IRS website, still shows single since my tax accountant amended my tax return from single to married filing separately (also, "NRA" on my spouse's ssn line) before April 15th and owed IRS. They already cashed my check (I owed IRS).

Questions,

1) Does IRS cashing my check mean that my amended return is approved by IRS?

2) should i go to the local IRS office to correct the martial status and get another transcript that should show "married" martial status?

2) Is it okay to send the copy of my tax returns (1040) and copy of amened tax returns (1040X) with w2 along the transcripts togther to NVC?

Any help would be appreciated. Thank you so much in advance.

I cannot answer 1.. I don't know. 2 is a possibility and you can certainly try. 3 you can send the tax returns and W2 and schedules intead of the transcripts.

I cannot answer 1.. I don't know. 2 is a possibility and you can certainly try. 3 you can send the tax returns and W2 and schedules intead of the transcripts.

Thanks! I will go to the local IRS office. Otherwise, I will send the copies of tax returns including 1) 1040, 1040X and W2 of 2013 and 2) 1040 and W2 of 2011 and 2012.

3) if you get to the stage of submitting your tax Info to NVC before your amended return is processed... then yes, I think its okay to submit a copy of the 1040X amended return with the W2 for that year with the original un-amended tax transcript to establish that you submitted your amendment and its still under process at IRS.

Thanks! I just went to the IRS website to see where my amended return is. It said it is still in process. You are right that it said "8 to 12 weeks". :) I wish the processing times of I-130 would say 8-12 weeks instead of 5 months! ha!

Hi I also filed my taxes as single and I don't have SSN for my husband and I don't know how to get itin number I'm a January 2014 filer and were waiting on approval for our i-130 so I want to amend it for NVC also I haven't gotten my return check yet and I can't wait until I get the check to amend because I'm applying for financial aid for school and I need it amended before the end of this month so I'm planning on amending my taxes now, can I just put "NRA" in the social security section for my husband?

Yes you can amend the tax return by putting NRA in the social security # section for your husband. You will have mail a paper copy though. Most tax software would not allow you to submit the amendment if you did not enter the SS # of your spouse.
