Visa and medical packet question on k2 portion?

Hi All

Question

My fiancée is flying out and has her visa and the (singular) medical packet. Her daughter is flying out in 2-3 months and has her K2 visa. Her Daughter K2 has no medical packet, it's all in one bundle.

I called the so helpful UStraveldocs but I just do not trust them.

I'm assuming the medial packet is submitted for AOS later on. But want to make sure her daughter when coming to the US will not have any issues with her K2.

The daughter should not have a K-2 visa in her passport if she if planning "To Follow". When she is ready to travel, then she'd have her medical and Embassy interview. Contact the Embassy to have them remove the visa.

Do dependent children receiving K-2 visas need to travel to the United States at the same time as the K-1 beneficiary?

No, eligible dependent children can travel to the United States on a K-2 visa within a year of the issuance of the K-1 visa to the principal beneficiary.

This is true even if the K-1 beneficiary has subsequently married, provided the dependent child is still unmarried and under 21 years of age at the time of K-2 issuance.

If a dependent child of your Fiance seeks to enter the United States more than one year after your Fiance has received a K-1 visa, it will be necessary to file an immigrant visa petition for the child

That is totally against every portion of information I've ever gotten.

Then you've received very bad information....obviously not from here on VJ.

One lists ALL children on the 129f and G325 forms, when filing the initial petition.

Then, on the DS-156K form back in the old days, or on the new online D-160 form, you list children are "To Join" (meaning come with the parent and which are "To Follow" (meaning will come later, but within a year's time of the parent's visa issuance).

The To Join children attend their medical and come to the Embassy interview with the parent.

The To Follow children stay home. When it is near their time to obtain a visa, the Embassy is notified and they do to their medical. Then they will have their own interview and have their visa placed into their passport.

This is the way it always have been.

Yes she will have issues at her POE since they will want to take her packet from her. This is a big problem.

I have read that if you have a K-2 Visa, that you are free to join up to a year from the date the K-1 was issued - I would think regardless of wheter it is a join or a follow-to-join. I think they denote these terms so that you can decide to take your children with you and have the K2 issued at the same time - or wait until a later date and they could get their K2 issued later. Whether the k2 is issued now or 9 months from now, they both will expire a year from the K1 issuance date.

I have read scenarios on here (mainly people from Canada) where people were issued a K1 but they were still visitng their loved one without using the K1 visa (stating to the officer that they are not planning to use the K1 now, but at a later date - and entering the country by other visas or other means). Just off of my own uneasiness, I would not recommend doing this.

On the other hand, not sure if you would need another medical after waiting so long.

My advice. Call the consulate which issued your Visas. Explain your issue and present your questions. They should be able to assist.

Aug 06 2014: U.S. Arrival (Ft. Lauderdale POE)

Children (3 kids)

Apr 28 2015: Filed I130 petition for each child

Aug 21 2015: Notice from USCIS that all 3 petitions transferred to California Service Center

Sep 17 2015: Approval for all 3 petitions

Nov 12 2015: Paid one AOS fee for all 3 children

Nov 13 2015: Paid separate IV fees for all 3 children

Dec 04 2015: Filed Affidavit of Support (I864) for each child

Jan 12 2016: Received RFE for missing birth certificate from one of the kids packet

Jan 13 2016: Sent in RFE evidence ( birth certificate copy .... again O_o )

Jan 19 2016: Received notice that they received the RFE evidence

Feb 22 2016: Called and found out another RFE was being sent out about birth certificate

Feb 24 2016: Sent in (inextensa versions, not de acta versions) of birth certificates for all children

Mar 02 2016: Received notice that they received the RFE evidence

Mar 11 2016: NVC Process finished, now awaiting interview time slot to be scheduled

Mar 29 2016: Called NVC and found out today they scheduled interview

Apr 01 2016: Received Packet 4 notice via e-mail with interview date

Apr 25 2016: Children received P4 letters in the mail

May 19 2016: Interview

Jun 03 2016: Received Visas

Jul 06 2016: Travel to US
